【摘要】：全國人大常委會"釋法"既是個(gè)政治問題,又是個(gè)憲法問題。憲法解釋不僅有助于正確理解和適用憲法,而且有利于維護(hù)憲法的穩(wěn)定性與權(quán)威性,還能夠培養(yǎng)公民的憲法信仰。為此,應(yīng)區(qū)分憲法解釋與法律解釋,從憲法解釋啟動方式、憲法解釋議案的審議機(jī)構(gòu)、憲法解釋審議通過及公布等方面完善并激活憲法解釋程序機(jī)制。
[Abstract]:The NPC standing Committee's interpretation of the Law is not only a political issue, but also a constitutional issue. The interpretation of the constitution is not only helpful to understand and apply the constitution correctly, but also helps to maintain the stability and authority of the constitution, and to cultivate the constitutional belief of the citizens. Therefore, we should distinguish between constitutional interpretation and legal interpretation, perfect and activate the mechanism of constitutional interpretation procedure in the following aspects: starting mode of constitutional interpretation, deliberative organ of constitutional interpretation bill, adoption and publication of constitutional interpretation, etc.
