移動互聯(lián)網(wǎng)背景下網(wǎng)絡(luò)暴力治理研究

【摘要】：因特網(wǎng)從最初進入人們視線,到現(xiàn)在已經(jīng)走過近二十年的時間。如今,移動互聯(lián)網(wǎng)逐漸成為人們生活中重要的一部分,它在為網(wǎng)民帶來更多便利、自由的空間的同時,也為網(wǎng)絡(luò)暴力提供了平臺。網(wǎng)絡(luò)暴力從最初在PC端興起到如今蔓延至移動端,對網(wǎng)絡(luò)環(huán)境與網(wǎng)民都帶來極大的消極影響。對網(wǎng)絡(luò)暴力在新的時代背景下的發(fā)展狀況和特征進行分析,可以讓我們更加清晰地把握網(wǎng)絡(luò)暴力現(xiàn)狀,并提出相應(yīng)的治理策略,以凈化網(wǎng)絡(luò)環(huán)境。網(wǎng)絡(luò)暴力從最初產(chǎn)生到如今可以劃分為三個階段。1994年到2001年是其萌芽階段;2001到2006年是網(wǎng)絡(luò)暴力開始產(chǎn)生階段;2006年至今網(wǎng)絡(luò)暴力迅速蔓延,并在移動互聯(lián)網(wǎng)時代背景下呈現(xiàn)新的特征:參與主體低齡化、定向攻擊精準化、情緒表達極端化等。網(wǎng)絡(luò)暴力的治理對象應(yīng)當(dāng)包括:參與網(wǎng)民、媒體以及移動端各類應(yīng)用、網(wǎng)絡(luò)提供商和服務(wù)商等。網(wǎng)絡(luò)暴力的治理模式需要在傳統(tǒng)的政府主導(dǎo)型的基礎(chǔ)上,不斷豐富行業(yè)及個人自律為主型、司法機關(guān)強勢介入型等模式。而今,我國對網(wǎng)絡(luò)暴力的治理已經(jīng)取得一定成效:逐漸形成完善的體系,各責(zé)任人認定逐漸明晰,網(wǎng)絡(luò)實名制也被推上日程。但是,我國依然還存在治理主體單一、治理手段和技術(shù)滯后,治理的法律法規(guī)可操作性弱等缺陷。從移動互聯(lián)網(wǎng)時代背景分析,主要是信息時效性更強,碎片化特征明顯、傳播渠道增加及主體價值觀多元化等原因加大了治理難度。在此背景下的網(wǎng)絡(luò)暴力治理需要不斷完善:一是發(fā)揮多個主體的合力,二是在治理環(huán)節(jié)上加強綜合性,三是在治理手段上不斷推進法制化。
[Abstract]:The Internet has been in sight for nearly twenty years since it first came into view. Nowadays, mobile Internet has become an important part of people's life. It not only brings more convenience and free space for Internet users, but also provides a platform for cyber violence. From the beginning of the rise of network violence in the PC to now spread to the mobile side, which has a great negative impact on the network environment and Internet users. By analyzing the development and characteristics of network violence in the new era, we can grasp the current situation of network violence more clearly, and put forward corresponding management strategies to purify the network environment. Cyberviolence can be divided into three stages from the beginning to the present. 1994 to 2001 was its infancy. From 2001 to 2006, it was the beginning of cyberviolence. Since 2006, cyberviolence has spread rapidly. Under the background of mobile Internet era, it presents new features: younger age of participants, precision of targeted attack, extreme expression of emotion, etc. The governance objects of network violence should include participating Internet users, media and mobile applications, network providers and service providers. The governance model of network violence needs to be based on the traditional government-led model, to enrich the industry and individual self-discipline, and to strengthen the judicial intervention model. At present, the governance of network violence in our country has achieved certain results: gradually formed a perfect system, the responsibility gradually clear, the network real name system has been put on the agenda. However, there are still some defects in our country, such as the single governance subject, the lag of governance means and technology, and the weak operability of laws and regulations. From the background analysis of the mobile Internet era, the main reasons are that the information is more effective, the fragmentation is obvious, the communication channels are increasing and the main values are diversified, and so on, which makes the governance more difficult. In this context, the governance of network violence needs to be constantly improved: first, to bring into play the resultant force of many subjects; second, to strengthen the comprehensive aspects of governance; third, to continuously promote the legalization on the means of governance.
