我國地方政府與民營企業(yè)非規(guī)范交換關(guān)系研究

【摘要】:政府和企業(yè)作為經(jīng)濟(jì)社會(huì)中的兩大運(yùn)行組織,二者之間的互動(dòng)關(guān)系是社會(huì)權(quán)力結(jié)構(gòu)中十分重要的部分。理解了一個(gè)國家的政企關(guān)系,也就從宏觀上把握了這個(gè)國家的經(jīng)濟(jì)結(jié)構(gòu)。改革開放三十多年以來,我國社會(huì)和經(jīng)濟(jì)得到了快速的發(fā)展,一批民營企業(yè)伴隨改革的進(jìn)程逐步發(fā)展壯大,其發(fā)展態(tài)勢(shì)與我國經(jīng)濟(jì)結(jié)構(gòu)的調(diào)整緊密相關(guān)。目前我國仍處于政府主導(dǎo)的市場(chǎng)經(jīng)濟(jì)體系之中,政府對(duì)經(jīng)濟(jì)的干預(yù)力度較大,市場(chǎng)化程度不足的問題也體現(xiàn)在政企關(guān)系上,在促進(jìn)經(jīng)濟(jì)市場(chǎng)化的進(jìn)程中,理順政企關(guān)系是處理政府與市場(chǎng)關(guān)系的重點(diǎn)。 政府在國家政治、經(jīng)濟(jì)、社會(huì)方面發(fā)揮著多重作用決定了其必然成為企業(yè)最重要的環(huán)境因素,也是企業(yè)最重要的利益相關(guān)者之一。我國長期以來實(shí)行的是政府主導(dǎo)型經(jīng)濟(jì)發(fā)展模式,政府在資源配置中有舉足輕重的作用。因此,如何與政府打交道,如何處理與政府的關(guān)系自然就成為企業(yè)在經(jīng)營中面臨的主要問題之一,企業(yè)的政治行為就隨之而來。另一方面,我國本來就是一個(gè)注重關(guān)系的人情社會(huì),企業(yè)與政府的關(guān)系更是密切。正是在這種背景下,政府與企業(yè)的互動(dòng)中,難免會(huì)出現(xiàn)不規(guī)范的行為,比如政商勾結(jié)已導(dǎo)致嚴(yán)重的腐敗問題。當(dāng)前的腐敗案件,特別是嚴(yán)重的經(jīng)濟(jì)犯罪案件中,地方政府官員與民營企業(yè)家勾結(jié)、利用導(dǎo)致國家經(jīng)濟(jì)財(cái)產(chǎn)遭受損失,這一類案件已經(jīng)占到官員腐敗案件的很大一部分。可見由于我國社會(huì)依舊處于轉(zhuǎn)型期,市場(chǎng)機(jī)制尚待健全,社會(huì)利益分化加劇,在企業(yè)與政府的互動(dòng)中不可避免地會(huì)潛藏違法、違紀(jì)及有悖于社會(huì)公德的交易,衍生出大量的企業(yè)不當(dāng)政治行為,使企業(yè)政治行為的應(yīng)然性空間與實(shí)然性空間存在背離,這就構(gòu)成本文研究的主題——地方政府與民營企業(yè)之間的非規(guī)范交換問題。 本文從交換理論的視角入手,首先界定了非規(guī)范交換的概念,列舉了非規(guī)范交換的幾種表現(xiàn)形式,接著分別從交換理論、政府俘獲理論和地方法團(tuán)主義三個(gè)理論角度對(duì)非規(guī)范交換的概念加以說明。在上述理論分析的基礎(chǔ)上,結(jié)合我國民營企業(yè)發(fā)展現(xiàn)狀,對(duì)非規(guī)范政企交換行為的機(jī)制進(jìn)行深入分析,歸納出其發(fā)生的原因和帶來的危害,以政府主導(dǎo)的非規(guī)范交換——無錫尚德破產(chǎn)重整和企業(yè)主導(dǎo)的非規(guī)范交換——皇明太陽能案例作為實(shí)證分析部分,進(jìn)一步驗(yàn)證上述幾章的分析結(jié)果。最后,在規(guī)范政企交換關(guān)系的對(duì)策和建議方面,本文認(rèn)為應(yīng)轉(zhuǎn)變地方政府政績觀和考核辦法,建立政府自律機(jī)制和企業(yè)自律機(jī)制。建立完善的市場(chǎng)機(jī)制,使企業(yè)成為真正意義上的市場(chǎng)主體。從政府角度來看,應(yīng)當(dāng)簡(jiǎn)政放權(quán)、轉(zhuǎn)變職能,回歸提供公共服務(wù)和公共物品的角色本位,,規(guī)范行政自由裁量權(quán)的運(yùn)用。從企業(yè)的角度來看,應(yīng)當(dāng)進(jìn)一步完善治理結(jié)構(gòu),提高企業(yè)自主創(chuàng)新能力,并積極承擔(dān)社會(huì)責(zé)任。從整個(gè)社會(huì)的他律體系來看,政企交換關(guān)系的規(guī)范離不開企業(yè)利益相關(guān)者的監(jiān)督和約束,非規(guī)范政企交換的懲處機(jī)制也亟待建立。
[Abstract]:The government and enterprise as the two operating organizations in the economic society, the interactive relationship between the two is a very important part of the social power structure. Understanding the relationship between government and enterprise in a country has also grasped the economic structure of the country from the macro level. With the reform and opening up for more than 30 years, the society and economy of our country have been rapidly developed. The development trend of a group of private enterprises is gradually growing with the process of reform. The development trend is closely related to the adjustment of the economic structure of our country. At present, our country is still in the market economy system dominated by the government, the government has a great intervention in the economy, and the problem of the lack of marketization is also embodied in the relationship between the government and the enterprise, and promotes the economic marketization. In the process, straightening out the relationship between government and enterprises is the key to deal with the relationship between the government and the market.
The government plays a multiple role in the political, economic and social aspects of the country, which determines that it is the most important environmental factor and one of the most important stakeholders of the enterprise. China has long implemented a government led economic development model, and the government plays an important role in the allocation of resources. Therefore, how to do with the government How to deal with the relationship with the government naturally becomes one of the main problems that the enterprise faces, and the political behavior of the enterprise is followed. On the other hand, our country is a human society which pays attention to the relationship, and the relationship between the enterprise and the government is more closely. It is in this context that the interaction between the government and the enterprise is unavoidable. In the current corruption cases, especially in the serious economic crime cases, local government officials collude with private entrepreneurs and make use of the loss of national economic property. This kind of case has already accounted for a large part of the official corruption cases. In our country, the society is still in the transition period, the market mechanism remains to be improved and the differentiation of social interests is aggravated. In the interaction of the enterprise and the government, the illegal, disciplinary and contrary to the social ethics are inevitably hidden, and a large number of improper political actions have been derived from the enterprise. This constitutes the theme of this study -- the non-standard exchange between local governments and private enterprises.
Starting with the perspective of exchange theory, this paper first defines the concept of nonstandard exchange, lists several forms of non normative exchange, and then explains the concept of nonstandard exchange from three angles of exchange theory, government capture theory and local corporatism. On the basis of the above theoretical analysis, it combines with my people. The current situation of enterprise development and the mechanism of non standard government and enterprise exchange behavior are deeply analyzed, and the causes and hazards are summed up. The non standard exchange dominated by the government - the Wuxi Suntech bankruptcy reorganization and the non standard exchange of enterprise led by the enterprise -- the case of Emperor Ming solar energy as an empirical analysis part, to further verify the above In the end, in the aspect of standardizing the countermeasures and suggestions of the relationship between government and enterprise exchange, this paper thinks that we should change the local government's political achievements and assessment methods, establish the self-discipline mechanism of the government and the self-discipline mechanism of the enterprise, establish a perfect market mechanism to make the enterprises become the real market main body. From the point of view of the government, the government should simply release power, Change functions, return to the role of public service and public goods, standardize the use of administrative discretion. From the point of view of enterprise, we should further improve the governance structure, improve the ability of independent innovation of enterprises, and actively undertake social responsibility. From the perspective of the whole society, the regulation of the relationship between government and enterprise can not be separated from enterprises. The supervision and restriction of industry stakeholders, and the punishment mechanism of non-standard exchange between government and enterprises need to be established.
