【摘要】：韓國(guó)的央地事權(quán)劃分以地方自治為載體。從歷史來看,地方自治與央地分權(quán)經(jīng)過了初試、轉(zhuǎn)型、復(fù)蘇和深化等不同階段,不過,在各階段具有不同的動(dòng)力來源。從法律角度來看,《大韓民國(guó)憲法》和《地方自治法》是央地事權(quán)劃分主要的法律依據(jù);從基本特征而言,韓國(guó)的地方自治與央地分權(quán)屬于國(guó)家權(quán)力體系內(nèi)的分權(quán),并以大陸法系為底色,其主導(dǎo)者仍然為中央政府,并具有多重二元結(jié)構(gòu)。韓國(guó)地方自治與央地分權(quán)的實(shí)踐在思想認(rèn)識(shí)基礎(chǔ)、經(jīng)濟(jì)社會(huì)發(fā)展?fàn)顩r、借鑒外來制度、央地溝通協(xié)調(diào)機(jī)制和公民參與等方面,對(duì)于我國(guó)的央地事權(quán)劃分實(shí)踐具有借鑒意義。
[Abstract]:From the historical point of view, local autonomy and central land decentralization have passed the different stages of preliminary examination, transformation, resuscitation and deepening, but they have different power sources at various stages. From a legal point of view, the Republic of Korea constitution and the local autonomy law are the main legal basis for the division of the central government. According to the basic characteristics, the local autonomy and decentralization of the central land belong to the decentralization in the state power system, and the central government is still the central government and has a multiple two yuan structure. The practice of South Korea's local autonomy and the decentralization of the central land is the basis for the recognition of the thought, the development of the economy and the society, and the foreign system, The central government's communication and coordination mechanism and citizen participation are of great significance to China's central government's power division practice.
