【摘要】:養(yǎng)老機(jī)構(gòu)在我國(guó)養(yǎng)老服務(wù)體系建設(shè)中逐漸承擔(dān)起“支撐”的重任,成為“替天下兒女盡孝”的重要方式,人們期盼被送進(jìn)養(yǎng)老機(jī)構(gòu)的老人能夠在衣食起居和精神上得到更好的幫助和關(guān)懷。然而,近年來(lái)養(yǎng)老機(jī)構(gòu)事故頻發(fā),嚴(yán)重侵害到老人的人身、財(cái)產(chǎn)安全,這不僅是養(yǎng)老機(jī)構(gòu)自身內(nèi)部運(yùn)作不規(guī)范的問(wèn)題,還與養(yǎng)老機(jī)構(gòu)行政監(jiān)管的相關(guān)立法不完善有關(guān)。面對(duì)現(xiàn)實(shí)中養(yǎng)老機(jī)構(gòu)行政監(jiān)管立法存在的問(wèn)題,完善相關(guān)立法既能減少和避免養(yǎng)老機(jī)構(gòu)運(yùn)行中存在的問(wèn)題,又能保護(hù)老年人的合法權(quán)益。因此,進(jìn)一步加強(qiáng)養(yǎng)老機(jī)構(gòu)行政監(jiān)管立法,對(duì)我國(guó)養(yǎng)老機(jī)構(gòu)行政監(jiān)管制度的完善具有重要意義。本文立足我國(guó)養(yǎng)老機(jī)構(gòu)行政監(jiān)管的立法現(xiàn)狀,首先,從養(yǎng)老機(jī)構(gòu)的概念和分類(lèi)入手,對(duì)養(yǎng)老機(jī)構(gòu)行政監(jiān)管立法的內(nèi)容進(jìn)行了闡釋,并從養(yǎng)老機(jī)構(gòu)行政監(jiān)管機(jī)關(guān)、養(yǎng)老機(jī)構(gòu)以及老年人權(quán)益保護(hù)等三個(gè)方面,分析了加強(qiáng)我國(guó)養(yǎng)老機(jī)構(gòu)行政監(jiān)管立法的必要性。其次,通過(guò)梳理我國(guó)養(yǎng)老機(jī)構(gòu)行政監(jiān)管的立法現(xiàn)狀,在準(zhǔn)入監(jiān)管上,提出了養(yǎng)老機(jī)構(gòu)申請(qǐng)人的資質(zhì)條件不合理、護(hù)理員的資質(zhì)要求低且配置比例不明確以及缺乏具體的資金要求等問(wèn)題;在運(yùn)營(yíng)監(jiān)管上,提出了運(yùn)營(yíng)者資質(zhì)條件和審查程序上的不足、運(yùn)營(yíng)監(jiān)管方式的缺陷以及補(bǔ)貼政策的不合理性等問(wèn)題;在退出監(jiān)管上,提出了退出申請(qǐng)、清算制度的缺陷以及退出善后處理制度不具體等問(wèn)題,并從客觀方面、主觀方面以及現(xiàn)有立法的操作性等方面對(duì)產(chǎn)生這些問(wèn)題的原因進(jìn)行了分析。最后,通過(guò)借鑒域外養(yǎng)老機(jī)構(gòu)的行政監(jiān)管立法制度,從確立規(guī)范的準(zhǔn)入行政監(jiān)管制度、進(jìn)一步完善運(yùn)營(yíng)行政監(jiān)管制度及建立健全退出行政監(jiān)管制度等三個(gè)方面,分別提出了立法完善的建議。
[Abstract]:In the construction of China's pension service system, pension institutions have gradually assumed the heavy responsibility of "supporting" and become an important way to "do filial piety for the children of the world". People look forward to receiving better help and care in food, clothing and spirit for the elderly who are sent to institutions for the aged. However, in recent years, the frequent accidents of pension institutions seriously encroach on the personal and property safety of the elderly, which is not only a problem of non-standard internal operation of pension institutions, but also related to the imperfect legislation related to the administrative supervision of pension institutions. In the face of the problems existing in the administrative supervision and legislation of pension institutions in reality, perfecting the relevant legislation can not only reduce and avoid the problems existing in the operation of pension institutions, but also protect the legitimate rights and interests of the elderly. Therefore, it is of great significance to further strengthen the legislation of administrative supervision of pension institutions in order to perfect the administrative supervision system of pension institutions in China. Based on the current legislative situation of the administrative supervision of pension institutions in China, this paper, first of all, starts with the concept and classification of pension institutions, explains the contents of the administrative supervision legislation of pension institutions, and starts with the administrative supervision organs of pension institutions. This paper analyzes the necessity of strengthening the administrative supervision and legislation of pension institutions in China from three aspects: pension institutions and the protection of the rights and interests of the elderly. Secondly, by combing the current legislative situation of administrative supervision of pension institutions in our country, the author puts forward that the qualification conditions of the applicants for pension institutions are unreasonable in terms of admission supervision. The qualification requirements of nurses are low, the allocation ratio is not clear, and the lack of specific financial requirements, and so on. The defects of operation supervision mode and the irrationality of subsidy policy, as well as the problems such as withdrawal application, defect of liquidation system and non-specific exiting post-treatment system, etc., are put forward, and from the objective aspect, Subjective aspects as well as the operational aspects of existing legislation to analyze the causes of these problems. Finally, by drawing lessons from the administrative supervision and legislation system of the overseas pension institutions, the author tries to establish a standardized access administrative supervision system, to further improve the operational administrative supervision system and to establish and improve the withdrawal administrative supervision system. The suggestions of legislative perfection are put forward respectively.
