【摘要】：未成年人犯罪是一個(gè)引起廣泛關(guān)注的社會(huì)問題,近年來我國(guó)的未成年人犯罪率持續(xù)上升。探究未成年人犯罪的動(dòng)機(jī),防止未成年人走上犯罪的道路,以及降低未成年人的犯罪率已經(jīng)成為舉世關(guān)注的社會(huì)問題。未成年人處在身心發(fā)展的巨變時(shí)期,一些刺激性的事變極易激發(fā)未成年人犯罪,而在目前我國(guó)還沒有完善的法律規(guī)范和社會(huì)制度來幫助未成年人維護(hù)自己的權(quán)益,引導(dǎo)他們及時(shí)疏導(dǎo)和治理自己的身心問題,社會(huì)和家庭對(duì)未成年人缺乏及時(shí)的關(guān)心和愛護(hù),忽略了他們的內(nèi)心感受,這些也是導(dǎo)致未成年人犯罪的因素。本文正是試圖從分析未成年人犯罪的動(dòng)因出發(fā),通過對(duì)我國(guó)現(xiàn)行未成年人保護(hù)法律制度的研究,綜合未成年人犯罪案例,從國(guó)家、社會(huì)、家庭三個(gè)方面綜合考察,就未成年人犯罪成因和預(yù)防對(duì)策做一研究。本文共分四個(gè)部分。第一部分是對(duì)當(dāng)前我國(guó)未成年人犯罪現(xiàn)狀及特點(diǎn)做一個(gè)梳理和總結(jié),認(rèn)為我國(guó)未成年人犯罪主體有低齡化的趨勢(shì)、犯罪類型日趨復(fù)雜、組織團(tuán)伙增多、犯罪主體的文化程度普遍偏低。第二部分是分析未成年人犯罪的成因,我國(guó)未成年人犯罪的原因比較復(fù)雜,主要有未成年人法律意識(shí)薄弱、我國(guó)立法和司法制度對(duì)未成年人的法律保護(hù)不完備、還有其他的社會(huì)環(huán)境也造成未成年人犯罪。第三部分我選取了一些在國(guó)外比較成功的預(yù)防未成年人犯罪的方法和經(jīng)驗(yàn),希望對(duì)我國(guó)預(yù)防未成年人犯罪起到一個(gè)借鑒作用。第四部分是緊接著第二部分提出的問題結(jié)合國(guó)外的成功經(jīng)驗(yàn),就我國(guó)如何預(yù)防未成年人犯罪提出一些措施。包括:完善合理的司法制度,刑法制度,審判制度,建立有效的社區(qū)服務(wù)機(jī)制,引進(jìn)國(guó)外優(yōu)秀的做法,全社會(huì)同抓共管,有效預(yù)防當(dāng)前我國(guó)未成年人犯罪的發(fā)生。
[Abstract]:Juvenile delinquency is a social problem that has aroused widespread concern. In recent years, the juvenile crime rate in our country has been on the rise. Exploring the motive of juvenile delinquency, preventing minors from taking the road of crime, and reducing the crime rate of minors have become the social problems that the whole world pays close attention to. Minors are in a period of great changes in their physical and mental development, and some irritating incidents can easily stimulate juvenile delinquency. However, at present, there are still no perfect legal norms and social systems in China to help minors safeguard their rights and interests. Guiding them to solve their own physical and mental problems timely, the society and family lack of timely care and care for minors, ignoring their inner feelings, these are also leading to juvenile delinquency factors. This paper attempts to analyze the causes of juvenile delinquency, through the study of the current legal system of the protection of minors in China, comprehensive cases of juvenile delinquency, from the state, society, family three aspects of a comprehensive investigation. This paper makes a study on the causes of juvenile delinquency and preventive countermeasures. This paper is divided into four parts. The first part is a summary of the current situation and characteristics of juvenile delinquency in China. The author thinks that the main body of juvenile delinquency has a trend of younger age, the types of crimes are becoming more and more complex, and the number of organized gangs is increasing. The education level of the subject of crime is generally on the low side. The second part is to analyze the causes of juvenile delinquency, the causes of juvenile delinquency in China are more complex, mainly because the legal consciousness of minors is weak, and the legal protection of minors is not complete in our legislation and judicial system. There are other social environments that also cause juvenile delinquency. In the third part, I choose some successful methods and experiences to prevent juvenile delinquency in foreign countries, hoping to play a reference role in preventing juvenile delinquency in our country. The fourth part puts forward some measures on how to prevent juvenile delinquency in our country. It includes: perfecting the reasonable judicial system, criminal law system, judicial system, establishing effective community service mechanism, introducing foreign excellent practices, managing the whole society together, effectively preventing the occurrence of juvenile delinquency in our country at present.
