【摘要】：近年來,隨著輔助生殖技術的發(fā)展,不孕不育人群已經(jīng)不再滿足于通過收養(yǎng)的方式來解決子嗣問題,而是希望通過輔助生殖技術來孕育自己的子女,使自己的生命能夠得以在具有血緣關系的子女身上延續(xù)。而代孕技術作為輔助生殖技術的一種,可以滿足因各種原因無法自己孕育孩子的不孕不育人群的生育愿望。在這一背景下,研究有限開放代孕技術并制定代孕親子關系認定的新規(guī)則無疑具有重要意義。本論文從分析代孕技術可能帶來的倫理和社會問題入手,提出代孕技術如果不進行規(guī)制,將可能產(chǎn)生人倫關系混亂、個體身份認同危機、代孕母親和嬰兒人性尊嚴損害等方面的問題,在此基礎上,論文提出應在遵循生命倫理原則,即不傷害原則、有利原則、尊重原則和公正原則的前提下,有限度地開放和使用代孕技術,以滿足不孕不育夫婦的生殖愿望,實現(xiàn)其生殖需求�？紤]到代孕技術運用過程中最難處理的是親子關系的認定問題,論文在查閱大量文獻資料的基礎上,提出應完善我國的相關法律法規(guī)規(guī)定,加強思想教育和引導,從制定代孕父母親身份的認定規(guī)則、提高代孕子女的法律地位、提升代孕親子法的效力位階、設立民間代孕監(jiān)管機構、加強醫(yī)者的道德自律、提升患方的責任意識等方面,引導人們正確、理性使用代孕技術,使之既能造福人類,同時又能避免相關社會問題的發(fā)生。
[Abstract]:In recent years, with the development of assisted reproductive technology, infertile people are no longer satisfied with the adoption to solve the problem of children, but hope to use assisted reproductive technology to breed their children.So that their lives can be extended in the blood of the children.Surrogate technology, as a kind of assisted reproductive technology, can satisfy the desire of infertile people who can not give birth to their own children for various reasons.Under this background, it is of great significance to study limited open surrogate technology and establish new rules of paternity relationship.Starting with the analysis of the ethical and social problems that surrogate technology may bring, this paper points out that if surrogacy technology is not regulated, it will lead to the confusion of human relations and the crisis of individual identity.On the basis of the damage to the human dignity of the surrogate mother and the infant, the paper puts forward that we should follow the principles of life ethics, that is, the principle of no harm, the principle of advantage, the principle of respect and the principle of justice.Limited access to and use of surrogacy technology to meet the reproductive aspirations of infertile couples to meet their reproductive needs.Considering that the most difficult problem in the application of surrogate technology is the recognition of parent-child relationship, the paper, on the basis of consulting a large amount of literature, proposes that we should improve the relevant laws and regulations of our country, strengthen ideological education and guidance.From the following aspects: establishing rules for the identification of surrogate parents, improving the legal status of surrogate children, enhancing the effective rank of surrogate parent-child laws, establishing civil surrogate supervision bodies, strengthening the moral self-discipline of doctors and raising the responsibility consciousness of patients, etc.Guiding people to use surrogacy correctly and rationally can not only benefit human beings, but also avoid the occurrence of related social problems.
