【摘要】：良好的自然環(huán)境是具有公共性的生態(tài)產(chǎn)品,一般認為,或者由政府這只“看得見的手”,或者由市場這只“看不見的手”來供給。然而,無論是政府手段還是市場手段,都存在一定失靈現(xiàn)象。事實上,傳統(tǒng)的治理方式已經(jīng)無法徹底解決環(huán)境問題。埃莉諾·奧斯特羅姆突破了在政府與市場之間非此即彼選擇的舊思維,在大量經(jīng)驗研究的基礎上,發(fā)現(xiàn)公共事物治理存在“第三條道路”。她指出,通過多中心自主治理的途徑,也可以解決公共物品供給問題,在“政府之手”與“市場之手”之外還存在“第三只手”,社會公眾的參與甚至可以有效填補政府與市場在公共事務治理過程中存在的不足。本研究將公共治理理論應用到我國環(huán)境問題中來,試圖從該理論中獲取解決我國公眾參與環(huán)境事務不足問題的一些啟發(fā)。現(xiàn)階段,盡管公眾參與在環(huán)境事務中所發(fā)揮出的積極作用已經(jīng)得到我國社會各界的廣泛認可。但是,受我國基本國情以及傳統(tǒng)環(huán)境治理模式影響,我國公眾參與的有效性難以得到切實保障。本文將從公眾參與的權(quán)利、意愿和能力三方面著手,分別對公眾能不能參與、公眾愿不愿參與和公眾會不會參與環(huán)境事務治理進行分析,探討改變我國公眾參與有效性不足的方法,從政府轉(zhuǎn)變治理理念、確認公眾參與權(quán)利,公眾提高自身參與意識以及環(huán)保非政府組織增強參與效能等不同角度,為加強我國公眾參與環(huán)境治理的有效性提供相對有效的措施。
[Abstract]:A good natural environment is a public ecological product, which is generally considered to be supplied either by the "visible hand" of the government or by the "invisible hand" of the market.However, whether the government means or market means, there is a certain failure phenomenon.In fact, the traditional way of governance has been unable to completely solve environmental problems.Eleanor Ostrom broke through the old thinking of choosing one or the other between government and market. On the basis of a great deal of empirical research, she found that there is a "third way" in public affairs governance.She points out that the supply of public goods can also be solved by means of multi-center autonomous governance, where there is a "third hand" in addition to the "hands of government" and "the hands of markets."The participation of the public can even effectively fill the shortcomings of the government and the market in the process of public affairs governance.This study applies the theory of public governance to the environmental problems of our country, and tries to get some inspiration from the theory to solve the problem of insufficient public participation in environmental affairs in our country.At present, although the public participation in environmental affairs has played an active role has been widely recognized by all walks of life in our country.However, the effectiveness of public participation in our country is difficult to be ensured by the basic conditions of our country and the traditional environmental governance model.This paper will analyze whether the public can participate, whether the public is willing to participate and whether the public will participate in environmental affairs governance from the three aspects of public participation right, will and ability.This paper discusses the methods to change the effectiveness of public participation in China, from different angles, such as changing the concept of governance, confirming the right of public participation, raising public awareness of participation and enhancing the participation effectiveness of environmental non-governmental organizations.To strengthen the effectiveness of public participation in environmental governance to provide relatively effective measures.
