從“國家主導(dǎo)”到多元推動——集體協(xié)商的新趨勢及其類型學(xué)

【摘要】:既有研究普遍認(rèn)為中國的集體協(xié)商是國家主導(dǎo)型模式,但通過在珠三角、長三角和東北等地的田野研究,本文發(fā)現(xiàn),由于勞動力市場供求關(guān)系變化、工人談判地位增強(qiáng)以及地方政府和雇主調(diào)整自身角色等原因,集體協(xié)商已經(jīng)呈現(xiàn)出多樣的類型,正在進(jìn)入一個(gè)多元推動的時(shí)代。從程序性規(guī)則和實(shí)體性規(guī)則這兩個(gè)維度出發(fā),本文建構(gòu)了一個(gè)集體協(xié)商的類型學(xué),將集體協(xié)商區(qū)分為國家主導(dǎo)、工人主導(dǎo)、雇主主導(dǎo)和工會主導(dǎo)四種類型,并從工人實(shí)體獲利、穩(wěn)定勞資秩序兩個(gè)方面對四種類型進(jìn)行了比較。本文進(jìn)一步分析了集體協(xié)商新類型的形成機(jī)制與實(shí)踐效果,認(rèn)為不同的工人組織化形態(tài)決定了不同的集體協(xié)商類型。最后,本文進(jìn)一步討論了集體協(xié)商未來可能的發(fā)展方向以及面臨的約束條件。
[Abstract]:The existing research is generally believed that collective bargaining is Chinese national leading mode, but through field research, in the Pearl River Delta, Yangtze River Delta and the Northeast China, this paper found that due to changes in supply and demand in the labor market, and enhance the bargaining position of local government workers and employers to adjust themselves the role of collective bargaining and other reasons, has been showing a variety of types that is entering a multi driven era. Starting from the procedural rules and substantive rules of the two dimensions, this paper constructs a type of collective negotiation, the collective negotiation is divided into state dominated, leading workers, employers and trade unions leading leading four types, and profit from the two aspects of workers entity. Stable labor order compares four types. This paper further analyzes the formation mechanism and practical effect of the collective negotiation of new types of workers that are determined by different organization form Different types of collective bargaining. Finally, this paper further discusses the possible future direction of collective negotiation and the constraints facing them.
