【摘要】：公眾參與是公眾為訴求和實(shí)現(xiàn)公共利益,通過多種合法途徑,參與到政府公共決策中去,并在決策制定中充分表達(dá)公眾意見,影響公共決策的行為過程。公眾有效參與到政府重大行政決策中來,不僅可以代表群眾表達(dá)最直接的訴求和意愿,而且還大大降低了政府行政風(fēng)險(xiǎn)以及政府運(yùn)作成本,最終也提高了政府工作效率。縣級政府處于城市和鄉(xiāng)村經(jīng)濟(jì)社會(huì)、文化政治、生態(tài)環(huán)境的中間環(huán)節(jié),其治理服務(wù)的對象具有分散廣、成分復(fù)雜、發(fā)展不均等特征,起著國家宏觀經(jīng)濟(jì)落實(shí)為微觀經(jīng)濟(jì)的中介作用,是轄區(qū)內(nèi)經(jīng)濟(jì)社會(huì)發(fā)展的決策機(jī)構(gòu),它直接面向基層,是貫徹落實(shí)黨和國家政策的一級關(guān)鍵職能部門。而且縣級政府在與公眾的互動(dòng)具直接性,容易實(shí)現(xiàn)實(shí)質(zhì)性公眾參與,體現(xiàn)公眾的利益訴求,因此做好縣級政府重大行政決策中的公眾參與工作,可以說是一項(xiàng)加快社會(huì)治理,構(gòu)建和諧社會(huì)的基礎(chǔ)性工作。本文在分析政府信息公開落實(shí)不到位、官本位思想依然存在、公眾參與決策的途徑不暢等問題的基礎(chǔ)上,提出進(jìn)一步完善信息公開立法、加強(qiáng)重大行政決策信息公開的制度實(shí)踐、建立協(xié)商民主決策制度、建立政府決策公開制度、規(guī)范政府公共決策程序、完善政府決策責(zé)任制度等措施,并對公眾參與下縣級政府作出的重大行政決策的決策范圍和決策程序提出了優(yōu)化建議。
[Abstract]:Public participation is the public's pursuit and realization of the public interest, through a variety of legal means, to participate in the government's public decision-making, and to fully express public opinions in decision-making. The effective participation of the public in the major administrative decisions of the government can not only express the most direct demands and wishes on behalf of the masses, but also greatly reduce the administrative risks of the government and the operating costs of the government. The county level government is in the middle of the city and rural economy, society, culture and politics, and ecological environment. The object of its governance and service has the characteristics of wide dispersion, complex composition and uneven development. It plays an intermediary role in the implementation of the state's macro-economy as a micro-economy, and is a decision-making body for economic and social development within the jurisdiction, which is directly oriented towards the grass-roots level. It is a key functional department at the first level to implement party and state policies. Moreover, county-level governments have a direct interaction with the public, which is easy to realize substantive public participation and reflect the interests of the public. Therefore, doing well the public participation in the major administrative decisions of county governments is a basic work to speed up social governance and build a harmonious society. On the basis of the problem that the way of public participation in decision-making is not smooth, it is proposed that the legislation on information disclosure should be further improved, the system practice of information disclosure of major administrative decisions should be strengthened, the system of consultation and democratic decision-making should be established, and the open system of government decision making should be established. Some measures, such as standardizing the government's public decision-making procedure and perfecting the responsibility system of government's decision-making, are put forward, and some suggestions are put forward to optimize the decision scope and decision-making procedure of the important administrative decision made by the county-level government under the participation of the public.
