【摘要】： 未成年人犯罪已成為一個社會公認的突出問題,狀況令人擔(dān)憂。預(yù)防未成年人犯罪不僅關(guān)系到國家穩(wěn)定和社會和諧,更關(guān)系到成千上萬的未成年人的成長。與此同時,未成年人的生活已經(jīng)和網(wǎng)絡(luò)越來越緊密地聯(lián)系在一起。一方面是不斷增長的犯罪趨勢,一方面是與網(wǎng)絡(luò)的關(guān)系越來越密切,兩者之間有何聯(lián)系?又是什么原因?qū)е逻@種聯(lián)系?筆者從研究中發(fā)現(xiàn)網(wǎng)絡(luò)對當(dāng)前的未成年人犯罪有著深刻影響。網(wǎng)絡(luò)究竟是怎樣影響到未成年人的犯罪率的?網(wǎng)絡(luò)引起了未成年人心理上的怎樣變化?這些變化與犯罪又有怎樣的關(guān)聯(lián)。這些問題無疑與未成年人犯罪原因理論密切相關(guān)。本文擬從未成年人犯罪的網(wǎng)絡(luò)成因入手,試圖能對未成年人犯罪原因的一般研究作出貢獻。 本文共分為五個部分,分別是:第一章、引言;第二章、網(wǎng)絡(luò)影響下的未成年人犯罪概述;第三章、未成年人犯罪的網(wǎng)絡(luò)成因分析;第四章、對網(wǎng)絡(luò)引發(fā)未成年人犯罪的預(yù)防對策;第五章、結(jié)論。 論文第一部分是引言,簡要闡述了當(dāng)前未成年人犯罪的情況以及與網(wǎng)絡(luò)的關(guān)聯(lián); 論文第二步分是對網(wǎng)絡(luò)影響下的未成年人犯罪進行概述,包括與網(wǎng)絡(luò)相關(guān)的未成年人犯罪的一般情況和主要特點、網(wǎng)絡(luò)對未成年人犯罪的具體影響以及本文研究的意義。論文指出,隨著信息時代的到來,未成年人犯罪與網(wǎng)絡(luò)的關(guān)系也越來越密切。網(wǎng)絡(luò)對未成年人犯罪的具體影響主要表現(xiàn)在三個方面:一、網(wǎng)絡(luò)不良信息對未成年人犯罪的影響,主要包括色情信息和暴力信息;二、上網(wǎng)交往對未成年人犯罪的影響,包括在網(wǎng)吧直接交友和網(wǎng)上交友;三、網(wǎng)絡(luò)成癮對未成年人犯罪的影響,主要是網(wǎng)絡(luò)費用導(dǎo)致的財產(chǎn)犯罪。通過對未成年人犯罪的網(wǎng)絡(luò)成因進行研究,可以有助于我們對未成年人犯罪原因的整體分析,從而有效預(yù)防和減少未成年人犯罪。同時,未成年人犯罪的網(wǎng)絡(luò)成因研究也是廣大未成年人健康成長的需要。 論文第三部分是是未成年人犯罪的網(wǎng)絡(luò)成因分析,這也是論文重點闡述的部分。論文借助犯罪學(xué)中犯罪原因理論中的若干假說解釋了網(wǎng)絡(luò)不良信息導(dǎo)致未成年人犯罪的原因、上網(wǎng)不良交往導(dǎo)致未成年人犯罪的原因、網(wǎng)絡(luò)成癮導(dǎo)致未成年人犯罪的原因,最后,論文指出,網(wǎng)絡(luò)對未成年人社會化過程的阻斷(這種阻斷包括容易造成未成年人自我同一和角色混淆、引起未成年人程度不同的交往障礙和挫折感、造成未成年人道德感、社會責(zé)任感的減弱,以及導(dǎo)致未成年人心理正常成長受阻),也許是造成未成年人犯罪更為根本的因素。 論文第四部分是預(yù)防網(wǎng)絡(luò)影響未成年人犯罪的對策。論文認為應(yīng)當(dāng)把教育、法治、和宏觀機制構(gòu)建作為預(yù)防網(wǎng)絡(luò)影響未成年人犯罪的對策。 論文第五部分是結(jié)論。
[Abstract]:Juvenile delinquency has become a prominent problem recognized by society, and the situation is worrisome. The prevention of juvenile delinquency is not only related to national stability and social harmony, but also related to the growth of thousands of minors. At the same time, the life of minors has become more and more closely linked to the Internet. On the one hand, there is a growing trend of crime, on the other hand, the relationship with the network is getting closer and closer, what is the relationship between the two? What causes this connection? The author finds from the study that the network has a profound impact on the current juvenile delinquency. How on earth does the network affect the crime rate of minors? How does the network cause how to change the psychology of minors? How do these changes have anything to do with crime? There is no doubt that these problems are closely related to the theory of the causes of juvenile delinquency. Starting with the network causes of juvenile delinquency, this paper tries to contribute to the general study of the causes of juvenile delinquency. This paper is divided into five parts, namely: the first chapter, introduction; the second chapter, an overview of juvenile delinquency under the influence of the network; the third chapter, the analysis of the network causes of juvenile delinquency; The fourth chapter, the prevention countermeasures of juvenile delinquency caused by the network; the fifth chapter, the conclusion. The first part of the paper is the introduction, which briefly expounds the current situation of juvenile delinquency and the relationship with the network. The second step of the paper is an overview of juvenile delinquency under the influence of the network, including the general situation and main characteristics of juvenile delinquency related to the network. The specific influence of the network on juvenile delinquency and the significance of this study. The paper points out that with the advent of the information age, the relationship between juvenile delinquency and the network is getting closer and closer. The specific impact of the network on juvenile delinquency is mainly manifested in three aspects: first, the impact of network bad information on juvenile delinquency, including pornographic information and violence information; Second, the influence of online communication on juvenile delinquency, including making friends directly and online in Internet cafes; third, the impact of Internet addiction on juvenile delinquency, mainly property crime caused by network expenses. Through the study of the network causes of juvenile delinquency, it can help us to analyze the causes of juvenile delinquency as a whole, so as to effectively prevent and reduce juvenile delinquency. At the same time, the study of the network causes of juvenile delinquency is also the need for the healthy growth of minors. The third part of the paper is the analysis of the network causes of juvenile delinquency, which is also the key part of the paper. With the help of some hypotheses in the theory of causes of crime in Criminology, this paper explains the causes of juvenile delinquency caused by bad information on the Internet, the causes of juvenile delinquency caused by bad communication on the Internet, and the causes of juvenile delinquency caused by Internet addiction. Finally, the paper points out that the network blocks the socialization process of minors (this blocking includes easy to cause minors' self-identity and role confusion, resulting in communication obstacles and frustration of different degrees of minors. The moral sense of minors, the weakening of social responsibility, and the hindrance of the normal psychological growth of minors may be more fundamental factors in juvenile delinquency. The fourth part of the paper is the countermeasures to prevent the network from affecting juvenile delinquency. The paper holds that education, the rule of law and the construction of macro-mechanism should be taken as the countermeasures to prevent the influence of the network on juvenile delinquency. The fifth part of the paper is the conclusion.
