【摘要】： “一對(duì)一”賄賂是賄賂行為的一種，是指行賄人和受賄人雙方通過(guò)某種方式達(dá)成默契，受賄人利用手中的權(quán)力和工作之便為行賄人謀取利益，行賄人在事前、事中或事后給受賄人好處，雙方在沒(méi)有第三人在場(chǎng)的情況下暗中進(jìn)行交易的行為。 隨著社會(huì)和經(jīng)濟(jì)的發(fā)展，“一對(duì)一”賄賂犯罪出現(xiàn)很多新情況，犯罪分子逃避偵查和反偵查能力明顯增強(qiáng)，給偵查部門(mén)的反貪工作提出了新的更大的挑戰(zhàn)。在新形勢(shì)下，如何轉(zhuǎn)變傳統(tǒng)觀念，全面掌握此類(lèi)案件的特征，探索新形勢(shì)下的“一對(duì)一”賄賂犯罪的偵查新思路，以精確有力地打擊“一對(duì)一"賄賂犯罪，有效遏制“一對(duì)一”賄賂犯罪成為擺在偵查機(jī)關(guān)面前一道嚴(yán)峻的課題。 基于此，筆者就新時(shí)期“一對(duì)一”賄賂犯罪案件的偵查思路進(jìn)行了探索，提出了“一對(duì)一”賄賂犯罪區(qū)別與普通賄賂犯罪的四大特征，指出了當(dāng)前“一對(duì)一”賄賂犯罪偵查面臨五大主要問(wèn)題，即一是缺乏證人證言，證據(jù)的單一、狹窄性給偵查帶來(lái)很大難度；二是犯罪手段的智能化及深度隱蔽性給偵查取證帶來(lái)很大困難；三是偵技水平和理念的落后降低了偵查人員的辦案能力；四是偵查技術(shù)的缺陷給案件的偵查帶來(lái)阻礙；五是案源線索和信息的短缺嚴(yán)重制約了偵查工作的效率。針對(duì)這些難點(diǎn)，，為了能順利偵破“一對(duì)一”賄賂犯罪案件，筆者從新時(shí)期“一對(duì)一”賄賂犯罪的偵查思路以及證據(jù)的收集兩大方面入手，分析了偵查線索來(lái)源及突破口的選擇，強(qiáng)調(diào)了偵查機(jī)關(guān)在辦案時(shí)的注重點(diǎn)；因?yàn)榭诠┰凇耙粚?duì)一”賄賂犯罪案件中起到至關(guān)重要的作用，所以筆者重點(diǎn)分析了口供的收集，這是偵破此類(lèi)案件的中心工作。在案件的偵查取證中，同時(shí)筆者強(qiáng)調(diào)了對(duì)間接證據(jù)的收集，正確收集和運(yùn)用間接證據(jù)，往往會(huì)使案件出現(xiàn)“柳暗花明又一村”的轉(zhuǎn)機(jī)。最后，筆者認(rèn)為對(duì)當(dāng)前“一對(duì)一”賄賂犯罪案件的偵查應(yīng)從四方面進(jìn)行完善，即完善我國(guó)技術(shù)偵查制度，加強(qiáng)“一對(duì)一”賄賂情報(bào)信息庫(kù)的建設(shè)，加強(qiáng)偵查人員偵查能力建設(shè)和偵查裝備建設(shè)以及加強(qiáng)偵查機(jī)關(guān)內(nèi)部及各部門(mén)之間的協(xié)作。希望此文能對(duì)新時(shí)期“一對(duì)一”賄賂犯罪案件的偵查能有所助益。
[Abstract]:"one-to-one" bribery is a kind of bribery behavior, which refers to the tacit understanding between the bribe-taker and the bribe-taker in some way. The bribe-taker makes use of the power and work in his hand to gain the benefit of the bribe-giver, and the bribe-payer is in advance. The act of secretly trading without a third person in favor of the bribe-taker, either in the event or after the event. With the development of society and economy, the crime of "one-to-one" bribery has appeared many new situations, and the ability of criminals to evade investigation and counter-investigation has been enhanced obviously, which poses a new and greater challenge to the anti-corruption work of investigation department. Under the new situation, how to change the traditional concept, grasp the characteristics of such cases in an all-round way, explore a new way of investigation of "one-to-one" bribery crime under the new situation, so as to crack down on the "one-to-one" bribery crime accurately and forcefully. Effectively curb "one-to-one" bribery crime has become a serious issue in front of the investigation organs. Based on this, the author explores the investigation ideas of "one-to-one" bribery crime in the new period, and puts forward four characteristics of the difference between "one-to-one" bribery crime and ordinary bribery crime. This paper points out that the current "one-to-one" bribery crime investigation faces five major problems, that is, the lack of witness testimony, the single evidence, the narrow nature of the investigation to bring a lot of difficulty; Second, the intelligence and deep concealment of criminal means bring great difficulties to the investigation and evidence collection; thirdly, the backwardness of the level and concept of investigation techniques reduces the investigative personnel's ability to handle cases; fourth, the defects of investigation techniques bring obstacles to the investigation of cases; Fifth, the shortage of source clues and information seriously restricts the efficiency of investigation. Aiming at these difficulties, in order to solve the crime of "one-to-one" bribery successfully, the author analyzes the source of investigation clue and the choice of breakthrough point from two aspects of investigation train of thought and evidence collection of "one-to-one" bribery crime in the new period. Emphasis is placed on the key points of the investigation organs when dealing with the case. Because confessions play a vital role in one-to-one bribery cases, the author focuses on the collection of confessions, which is the central task in detecting such cases. In the investigation and evidence collection of cases, at the same time, the author emphasizes the collection of indirect evidence, the correct collection and use of indirect evidence, will often make the case "turn around but there is another village" turn around. Finally, the author thinks that the investigation of the current "one-to-one" bribery crime should be improved from four aspects, namely, perfecting the technical investigation system of our country, strengthening the construction of "one-to-one" bribe intelligence information base, Strengthen the investigation capacity construction and investigation equipment construction and strengthen the cooperation among investigation organs and departments. I hope this article can be helpful to the investigation of one-to-one bribery crime in the new period.
