【摘要】： “飛車搶奪”犯罪是目前我國比較突出的一類犯罪,近年來,全國各地“飛車搶奪”案件頻頻發(fā)生,呈不斷蔓延、多發(fā)趨勢。由于犯罪分子使用高速行駛的機(jī)動(dòng)車(主要是摩托車)作為犯罪工具,所以這種犯罪行為往往在搶奪被害人隨身攜帶財(cái)物的同時(shí)造成被害人人身傷害的危害后果,特別是搶奪行為人對那些騎乘摩托車等機(jī)動(dòng)車輛的被害人進(jìn)行搶奪時(shí),更是經(jīng)常造成非常嚴(yán)重的人身傷害后果�！帮w車搶奪”犯罪嚴(yán)重危害人民群眾生命和財(cái)產(chǎn)安全,嚴(yán)重威脅著社會(huì)的安定和人民群眾的正常生活。因此對“飛車搶奪”犯罪多發(fā)原因及對策的研究對我國刑事立法、打擊犯罪、犯罪防控及社會(huì)和諧穩(wěn)定具有重要意義。 我國目前“飛車搶奪”犯罪在犯罪主體方面,犯罪的手段、方法、犯罪的時(shí)空、犯罪所侵害的對象、犯罪工具等方面都具有自身的特點(diǎn)。“飛車搶奪”犯罪之所以多發(fā),其原因主要有造成犯罪多發(fā)的社會(huì)環(huán)境方面,有關(guān)刑事法律不完善,公安機(jī)關(guān)打擊難度較大,打擊力度不夠,治安防控體系不夠健全,以及防控“飛車搶奪”犯罪的相關(guān)社會(huì)管理制度的不完善,同時(shí)被侵害對象自身的原因也是其中重要的因素。無論是對犯罪現(xiàn)象的研究還是對犯罪原因的研究,歸根到底是為了尋求犯罪預(yù)防的對策和措施,防治犯罪的發(fā)生。通過對犯罪現(xiàn)狀、特點(diǎn)及多發(fā)原因的分析,提出針對性的防治對策,主要從完善相關(guān)立法,治理主要職能機(jī)關(guān)公安部門加大打擊力度,更為重要的是著力建立一個(gè)有效的社會(huì)化防控體系。這就需要從預(yù)測犯罪、抑制犯罪動(dòng)機(jī)、限制犯罪機(jī)會(huì)和條件以及預(yù)防重新犯罪等多個(gè)方面考慮,運(yùn)用系統(tǒng)分析,實(shí)證分析等科學(xué)研究方法不斷實(shí)踐,最終建立完善的“飛車搶奪”犯罪社會(huì)化預(yù)防體系。
[Abstract]:The crime of "flying car snatch" is one of the most prominent crimes in our country at present. In recent years, the cases of "flying car snatch" have occurred frequently all over the country. Since criminals use high-speed motor vehicles (mainly motorcycles) as instruments of crime, such criminal acts often result in harmful consequences of personal injury to victims while seizing their belongings with them. Especially when the perpetrators rob the victims of motorized vehicles such as motorcycles, it often results in very serious personal injury consequences. The crime of "scooping by car" seriously endangers the life and property safety of the people, and threatens the social stability and the normal life of the people. Therefore, it is of great significance to study the causes and countermeasures of the frequent crime of "car snatching" in China's criminal legislation, crime control, crime prevention and control and social harmony and stability. In the aspect of crime subject, means, methods, time and space of crime, object of crime and instrument of crime and so on, the crime of "car snatching" in our country has its own characteristics at present in the aspect of crime subject, means, method, time and space of crime. The main reasons for the frequent occurrence of "flying car grabbing" crimes are the social environment that causes more crimes, the imperfection of the relevant criminal laws, the difficulty of the public security organs in cracking down, the insufficient intensity of the crackdown, and the insufficient perfection of the public security prevention and control system. It is also an important factor to prevent and control the related social management system of "rover snatching" crime and the reason of the target being infringed. Whether the study of crime phenomenon or the study of the causes of crime, in the final analysis is to seek crime prevention countermeasures and measures to prevent the occurrence of crime. Based on the analysis of the present situation, characteristics and causes of the crime, the paper puts forward some countermeasures to prevent and cure the crime, mainly from perfecting the relevant legislation and managing the main functional organs, the public security departments, to intensify the crackdown. What is more important is to establish an effective socialized prevention and control system. This needs to be considered from many aspects, such as forecasting crime, restraining criminal motives, restricting opportunities and conditions for crime and preventing re-offending, and using scientific research methods such as systematic analysis, empirical analysis, and so on. Finally, establish a perfect social prevention system of crime.
