【摘要】： 目前,邪教犯罪問題已經成為影響整個人類社會發(fā)展的毒瘤,受國際邪教犯罪和國內傳統邪教文化的影響,我國目前存在著三十余種邪教組織,邪教信徒人數約達200萬之多,并呈不斷擴張蔓延之勢。尤其是以“法輪功”為代表的邪教組織,已經逐步演變成為一股反政府、反社會、反人類的破壞性勢力,對國家政權的穩(wěn)定、社會的和諧發(fā)展、人民群眾的生命財產安全構成了嚴重威脅。因此,研究邪教犯罪的特點,客觀分析當前我國懲治邪教犯罪的法律體系,提出防治邪教犯罪問題的綜合性對策具有一定的現實意義。 本文除引言、結語外,共分四章:第一章首先對邪教、邪教犯罪的概念及特征進行了研究,從多個角度說明了邪教對個人、家庭、社會的嚴重危害;第二章客觀分析了當前我國邪教問題的現狀及邪教犯罪的發(fā)展趨勢,透視懲治邪教犯罪、防止邪教發(fā)展的必要性和重要意義;第三章結合《刑法》第300條、全國人大常委會的決定和“兩高”的三個司法解釋,分析了邪教犯罪的構成,并對司法實踐中常見的三種邪教犯罪進行了分析研究;最后從邪教違法行為的處罰、制定《反邪教法》、完善現行法律體系、加強國際交流與合作等七個方面提出了我國在防治邪教犯罪方面的意見和建議。
[Abstract]:At present, the crime of evil cults has become a cancer that affects the development of the whole human society. Under the influence of international cult crimes and domestic traditional cult cultures, there are at present more than 30 kinds of cult organizations in our country, and the number of cult followers amounts to about 2 million. And continue to expand and spread the trend. In particular, the cult organization represented by "Falungong" has gradually evolved into an anti-government, anti-social, anti-human destructive force, which has contributed to the stability of the state power and the harmonious development of society. The safety of the people's life and property poses a serious threat. Therefore, it is of certain practical significance to study the characteristics of cult crime, objectively analyze the current legal system of punishing cult crime in our country, and put forward comprehensive countermeasures to prevent and cure cult crime. In addition to the introduction and conclusion, this paper is divided into four chapters: the first chapter studies the concept and characteristics of cults, and explains the serious harm of cults to individuals, families and society from many angles. The second chapter objectively analyzes the current situation of cults in our country and the development trend of cult crimes, and analyzes the necessity and significance of punishing cults and preventing the development of cults. The third chapter analyzes the constitution of the crime of cults and studies the three common crimes of cults in judicial practice, combining the decision of the standing Committee of the National people's Congress and the three judicial interpretations of the "two High levels" in the light of Article 300 of the Criminal Law. Finally, from seven aspects of punishment for illegal cults, the formulation of the Anti-evil Law, the perfection of the current legal system, and the strengthening of international exchanges and cooperation, this paper puts forward our country's views and suggestions on preventing and controlling the crime of evil cults.
