廣東黑社會犯罪研究

【摘要】： 聯(lián)合國的官方文件將黑社會犯罪視為有組織犯罪。而關(guān)于有組織犯罪的概念，不同的國際組織及國家有各自不同定義，至今在世界范圍內(nèi)尚無精確、統(tǒng)一的概念。國際刑警組織對有組織犯罪作如下定義：任何具有有組織的控制結(jié)構(gòu)、通過不法活動獲取錢財(cái)為其主要目的的、通常以恐怖活動和腐敗活動經(jīng)濟(jì)來源為生的群體。 作為改革開放的前沿，也是境外黑社會組織滲透最早地區(qū)的廣東省，其如何根據(jù)本地區(qū)黑社會犯罪的實(shí)際情況以及整個國家黑社會犯罪的現(xiàn)狀和國際黑社會發(fā)展的趨勢，總結(jié)廣東反黑工作的實(shí)踐經(jīng)驗(yàn)，提出行之有效的對策是廣東必須解決的一個重大課題。 在研究廣東黑社會犯罪的過程中，不但要充分理解黑社會犯罪的基本理論，還要充分認(rèn)識廣東黑社會犯罪的現(xiàn)實(shí)問題。只有這樣才能有效地打擊本地區(qū)黑社會犯罪的不斷升級。因此，本文首先從黑社會犯罪的概念、表現(xiàn)形式、基本特征的理論分析入手，探討廣東黑社會犯罪的規(guī)律及其原因，然后結(jié)合廣東黑社會犯罪的基本情況進(jìn)行剖析，在最后對如何打擊遏制廣東黑社會犯罪提出對策。 文章的第一部分首先分析境內(nèi)外關(guān)于黑社會犯罪概念的各種論述，然后在此基礎(chǔ)上界定黑社會犯罪的內(nèi)涵。就境外關(guān)于黑社會犯罪概念的論述，大致存在四種代表性觀點(diǎn)：(一)、行為概念說。是指注重揭示黑社會犯罪的典型行為特點(diǎn)的定義理論。(二)、功能概念說。是指突出闡述黑社會犯罪的功能作用的定義理論。(三)、結(jié)構(gòu)概念說。是指注重分析黑社會犯罪的組織結(jié)構(gòu)和行為結(jié)構(gòu)的定義理論。(四)、廣狹概念說。是指從廣狹不同角度界定黑社會犯罪定義的理論。而我國學(xué)者關(guān)于黑社會犯罪概念有三種代表性觀點(diǎn)：(一)、基本特征定義說。該學(xué)說主張應(yīng)當(dāng)根據(jù)黑社會犯罪的性質(zhì)目的、組織 結(jié)溝、發(fā)展變化及黑社會的危害的基本特征綜合提煉黑社會犯罪的定義。 ．－）、廣狹概念說。該學(xué)說主張黑社會犯罪概念有廣狹之分。（三）、耗散結(jié) 溝學(xué)說。該理論分祈了累社會犯罪系統(tǒng)的特征運(yùn)行軌跡，較合理從開放、動 態(tài)、整體的系統(tǒng)角度界定了黑社會犯罪。筆者認(rèn)為該學(xué)說對黑社會犯罪概念 的界定是有科學(xué)理論根據(jù)的，其表述是完整深入的。其次，分析黑社會犯罪 的主要表現(xiàn)形式。最后概括各種黑社會犯罪的一殷性特征。 文章的第二部分主要是對廣東黑社會犯罪活動的基本情況進(jìn)行分析。 一、歷史概況。廣東黑社會犯罪經(jīng)歷了四個各具特點(diǎn)和程度的發(fā)展時期： 一）、廣東實(shí)行對外開放的1979年至1982年期間的境外滲入和萌芽階段； （二）、1986年至m88年期間的初步發(fā)展階段：（三）、go年代前期的多層次 擴(kuò)散階段；（四）、90年代后期“量質(zhì)并長” 的變化發(fā)展階段。二、廣東黑社 會犯罪的現(xiàn)狀：（一）、黑社會活動的主體未變，但組織及成員的具體構(gòu)成和 數(shù)量發(fā)主了明顯的變化和增長。（二）、黑社會滲透及涉累違法犯罪的活動內(nèi) 容不斷擴(kuò)展。（三）、黑社會犯罪的系列特征日益突出。三、廣東黑社會犯罪 的區(qū)域的特點(diǎn)：珠江三角洲地區(qū)與非珠江三角洲地區(qū)黑社會犯罪各具特點(diǎn)。 四、廣東黑社會的分層結(jié)構(gòu)。從人員結(jié)構(gòu)、組織結(jié)構(gòu)來看，廣東的黑社會犯 罪組織各具特點(diǎn)。 文章的第三部分分析廣東黑社會活動滋生和發(fā)展的原因。廣東黑社會活 動的產(chǎn)生有其歷史、地緣、主體、社會及經(jīng)濟(jì)、文化心理各個方面的原因。 廣東黑社會活動逐漸發(fā)展的主要原因有：第一，社會治安形勢的日趨復(fù)雜、 嚴(yán)俊，各類嚴(yán)重刑事犯罪大幅增多，發(fā)案率居高不下，而團(tuán)體犯罪、行業(yè)犯 罪、地方惡勢力犯罪及入境有組織犯罪的大量增多和不斷發(fā)展，更是直接地 為黑社會活動的惡性發(fā)展提供了現(xiàn)實(shí)的動態(tài)演化過程。第二，香港、澳門回 歸后，港澳地區(qū)黑社會活動情況的變化以及港澳臺地區(qū)、東甫亞各國警方大 規(guī)模的“掃黑” 行動，直接導(dǎo)致境外黑社會在廣東滲透及犯罪活動進(jìn)一步加 劇。第三，廣東省一些犯罪組織，如帶黑社會性質(zhì)的犯罪集團(tuán)、地方流氓惡 勢力骨干分子的“成熟化”，直接導(dǎo)致了－些新生的黑社犯罪組織的產(chǎn)生和日 益成型。第四，近年來，廣東外來人員的大量增多以及廣東各個城市城市化 進(jìn)程中較為富裕的本地居民特別是青少年缺少社會文化思想教育，逐漸惡性 發(fā)展為從事黑社會活動的“新生代”。第五，廣東黑社會活動經(jīng)歷了一段時期 2 約發(fā)晨后，，進(jìn)一步加大了公安、司法部R”I打己、訪范 二‘乍約準(zhǔn)度。桑八，系 統(tǒng)的反黑法津、政策暫時的欠缺以及周邊地區(qū)莊巨黑工詐中的協(xié)調(diào)作戰(zhàn)及合 作機(jī)制不健全，給黑社會發(fā)展帶來了可乘的機(jī)會和活動空間。
