公安民警違法違紀(jì)成因及對策

【摘要】: 公安民警違法違紀(jì)問題是公安機(jī)關(guān)隊(duì)伍建設(shè)中的重點(diǎn)、難點(diǎn)問題。本文立足工作實(shí)際,針對現(xiàn)行體制等的缺陷剖析了公安民警違法違紀(jì)行為形成的原因,并提出了一些具體的治理措施。 第一部分,剖析公安民警違法違紀(jì)行為的成因。文章從三方面進(jìn)行了剖析:一是從歷史的聯(lián)系方面進(jìn)行了簡要的分析;二是從體制方面剖析了存在的問題;三是在前兩方面剖析的基礎(chǔ)上,結(jié)合民警心理和社會(huì)環(huán)境實(shí)際,對利用職權(quán)貪污受賄、刑訊逼供、濫用槍支、徇私枉法、玩忽職守、從事非警務(wù)活動(dòng)等六個(gè)帶普遍性的問題進(jìn)行了較為詳細(xì)的剖析,闡述了這幾類典型違法違紀(jì)行為形成的基本原因。 第二部分,在第一部分分析原因基礎(chǔ)上提出了一些有針對性的遏制措施。這些措施包括:一是精簡基層公安機(jī)關(guān)內(nèi)部監(jiān)督機(jī)構(gòu),以集中監(jiān)督權(quán)力和監(jiān)督手段,強(qiáng)化整體防控能力和監(jiān)督職能;二是改革公安民警考核機(jī)制,制定百分制考核標(biāo)準(zhǔn),以增強(qiáng)考核的透明度,防止人事管理工作中的腐敗行為;三是明確“犯罪嫌疑人”的概念,以增強(qiáng)公安民警尊重人權(quán)的理念,逐步禁絕刑訊逼供行為;四是增強(qiáng)部分重大疑難或爭議較大治安案件裁決書的理性依據(jù),以防止濫用職權(quán)違法辦案;五是進(jìn)一步搞好領(lǐng)導(dǎo)班子建設(shè)和強(qiáng)化隊(duì)伍教育培訓(xùn)工作,以提高公安機(jī)關(guān)和公安民警整體素質(zhì),從源頭上預(yù)防和治理違法違紀(jì)行為;六是強(qiáng)化經(jīng)費(fèi)保障、推行工資體制改革,以遏制公安民警參與非警務(wù)活動(dòng)的發(fā)生。 文章對公安民警違法違紀(jì)行為成因的闡釋較為詳盡,,遏制措施的提出較為具體,具有較強(qiáng)的針對性和實(shí)用價(jià)值。
[Abstract]:The problem of violation of law and discipline by police is a key and difficult problem in the construction of public security organs. Based on the practice of the work, this paper analyzes the causes of the illegal behavior of the police in violation of discipline and puts forward some concrete measures to deal with the defects of the current system. The first part analyzes the causes of violation of law and discipline. The article has carried on the analysis from three aspects: first, has carried on the brief analysis from the historical connection aspect; second, has analyzed the existing problems from the system aspect; third, has combined the police psychology and the social environment reality on the basis of the first two aspects analysis, Six common problems, such as corruption and bribery by taking advantage of power, extorting confessions by torture, abusing guns, bending the law for favoritism, neglecting duties, engaging in non-police activities, were analyzed in more detail. This paper expounds the basic reasons for the formation of these typical violations of law and discipline. The second part, on the basis of the first part, puts forward some targeted containment measures. These measures include: first, to streamline the internal supervisory organs of the grassroots public security organs, to strengthen the overall prevention and control capability and the supervisory function by concentrating supervisory powers and means; and second, to reform the assessment mechanism of public security police and formulate the assessment standards for the percentage system. In order to enhance the transparency of assessment and prevent corruption in personnel management, the third is to clarify the concept of "criminal suspect", to strengthen the concept of police respecting human rights, and to gradually prohibit the practice of extorting confessions by torture. Fourth, to strengthen the rational basis for ruling awards in some major difficult or controversial public order cases in order to prevent abuse of power and illegal handling of cases; fifthly, to further do a good job in building leading groups and strengthening the education and training of the contingent. In order to improve the overall quality of public security organs and police, to prevent and control illegal and disciplinary violations from the source; sixthly, to strengthen the funds guarantee and carry out the reform of the wage system, in order to curb the police officers from participating in non-police activities. The article explains the cause of the violation of law and discipline of the police in detail, and puts forward the containment measures in detail, which has strong pertinence and practical value.
