【摘要】： 未成年人是祖國(guó)的未來(lái),民族的希望,維護(hù)他們的合法權(quán)益,保障他們健康成長(zhǎng),關(guān)系到社會(huì)主義現(xiàn)代化建設(shè)的成敗,國(guó)家的前途。特別是犯罪的未成年人,如何挽救、感化、教育,使他們改過(guò)自新,成為有用之材,就需要建立行之效的、完整的矯正機(jī)制。未成年人犯罪不同于成年人犯罪,本文客觀、詳細(xì)地分析了未成年人犯罪的概念、特征、犯罪構(gòu)成,及未成年人犯罪的特點(diǎn)、成因。在深入地了解未成年人犯罪特點(diǎn)、成因后,針對(duì)未成年人犯罪所具有的獨(dú)特“個(gè)性”,分析了現(xiàn)階段未成年人犯罪矯正制度的狀況,找出現(xiàn)行矯正機(jī)制存在的主要問(wèn)題、缺陷。在理念上進(jìn)行變革,對(duì)未成年人犯罪以教育為主,刑罰輕刑化。又考察了國(guó)外矯正未成年人犯罪的幾種機(jī)制,起訴、判決猶豫制度、前科消滅制度,取其精華,提出完善、建立具有中國(guó)特色的、符合國(guó)情的未成年人犯罪矯正機(jī)制。
[Abstract]:Minors are the future of the motherland, the hope of the nation, safeguarding their legitimate rights and interests, ensuring their healthy growth, related to the success or failure of socialist modernization, the future of the country. Especially for the delinquent minors, how to save, influence and educate them, and make them become useful materials, we need to establish effective, complete corrective mechanism. Juvenile delinquency is different from adult crime. This paper analyzes in detail the concept, characteristics, constitution, characteristics and causes of juvenile delinquency. After deeply understanding the characteristics and causes of juvenile delinquency, aiming at the unique personality of juvenile delinquency, this paper analyzes the current situation of juvenile delinquency correction system, and finds out the main problems and defects of the current correction mechanism. In the concept of reform, minor crime to education, light punishment. It also examines several mechanisms of correcting juvenile delinquency in foreign countries, such as prosecution, decision hesitating system, criminal record elimination system, taking its essence, and puts forward the perfection and establishment of juvenile delinquency correction mechanism with Chinese characteristics and in accordance with the national conditions.
