【摘要】： 白領(lǐng)犯罪作為犯罪學(xué)對(duì)犯罪的一種特殊分類(lèi),從犯罪主體角度表明犯罪人在經(jīng)濟(jì)狀況、社會(huì)階層、文化層次上的優(yōu)勢(shì)地位。白領(lǐng)階層在某種程度上引領(lǐng)著社會(huì)普通人群的價(jià)值取向、消費(fèi)趨向。然而,近年來(lái)白領(lǐng)犯罪愈演愈烈的形勢(shì)對(duì)大眾社會(huì)心理、犯罪成因的一般理論提出了嚴(yán)峻挑戰(zhàn)。 白領(lǐng)犯罪的形成原因較為復(fù)雜,是主觀與客觀、內(nèi)因與外因、社會(huì)與個(gè)體等多種因素綜合作用的結(jié)果。人生價(jià)值觀錯(cuò)位、強(qiáng)烈的物欲和貪利動(dòng)機(jī)、消極的職業(yè)人格特征是白領(lǐng)犯罪得以形成的主觀動(dòng)因;而社會(huì)浮躁心理的影響、犯罪控制制度薄弱、法律不健全、執(zhí)法不力則客觀上為白領(lǐng)犯罪的滋生、蔓延提供了外在條件。 面對(duì)來(lái)勢(shì)迅猛的白領(lǐng)犯罪現(xiàn)狀,我國(guó)的防范體系尚有待進(jìn)一步完善,尤其要加強(qiáng)對(duì)白領(lǐng)犯罪形成因素的深入研究,為反白領(lǐng)犯罪實(shí)踐提供理論指導(dǎo)。從對(duì)白領(lǐng)犯罪的一般預(yù)防來(lái)看,加強(qiáng)對(duì)白領(lǐng)亞文化的影響與改造、建立積極的白領(lǐng)文化,加強(qiáng)單位內(nèi)部犯罪控制制度、加大犯罪成本,適當(dāng)加大打擊力度、加大白領(lǐng)犯罪風(fēng)險(xiǎn)等都是實(shí)踐證明的有效之策。同時(shí),加強(qiáng)對(duì)白領(lǐng)犯罪人的再犯預(yù)防,也是一個(gè)不容忽視的因素。 本文共分四章: 第一章介紹白領(lǐng)犯罪的現(xiàn)狀。白領(lǐng)是社會(huì)的中上層群體,但近年其犯罪率卻持續(xù)上升。白領(lǐng)犯罪的特點(diǎn)有:犯罪人文化層次和地位高、犯罪手段的技術(shù)高、犯罪行為的隱蔽性強(qiáng)、犯罪活動(dòng)的組織性突出、犯罪方式的非暴力性特征明顯。第二章分析白領(lǐng)犯罪的成因,可以看到白領(lǐng)犯罪受到主觀與客觀等多種因素的影響。主觀方面如人生價(jià)值觀錯(cuò)位、強(qiáng)烈的物欲和貪利動(dòng)機(jī)、消極的職業(yè)人格特征等;客觀方面如社會(huì)浮躁心理的影響、犯罪控制制度薄弱、法律不健全,執(zhí)法不力等。 第三章特別闡述白領(lǐng)文化與白領(lǐng)犯罪問(wèn)題。當(dāng)今白領(lǐng)文化已經(jīng)逐步偏離主流文化的軌道,成為白領(lǐng)犯罪的重要誘因,并給案件的調(diào)查處理帶來(lái)困難。因此,
[Abstract]:White collar crime, as a special classification of crime in criminology, shows the superior position of criminal in economic condition, social stratum and culture level from the angle of criminal subject. To a certain extent, the white-collar class leads the value orientation and consumption trend of the general population. However, in recent years, the situation of white-collar crime has posed a severe challenge to the general theory of mass social psychology and the causes of crime. The formation of white-collar crime is complicated and is the result of various factors, such as subjective and objective, internal and external, social and individual. Life values mismatch, strong material desire and greedy motive, negative professional personality characteristics are the subjective motivation for the formation of white-collar crime, but the social impetuous psychological influence, the crime control system is weak, the law is not perfect, Weak law enforcement objectively for the breeding of white-collar crime, spread to provide external conditions. In the face of the situation of white-collar crime, the prevention system of our country needs to be further improved, especially to strengthen the in-depth study on the forming factors of white-collar crime, to provide theoretical guidance for the practice of anti-white-collar crime. From the general prevention of white-collar crime, we should strengthen the influence and reform on white-collar subculture, establish a positive white-collar culture, strengthen the internal crime control system, increase the cost of crime, and appropriately intensify the crackdown. Increasing the risk of white-collar crime is an effective strategy proved by practice. At the same time, to strengthen the prevention of recurrence of white-collar offenders, is also a factor that can not be ignored. This article is divided into four chapters: the first chapter introduces the current situation of white-collar crime. White-collar workers are the upper-middle class of society, but in recent years its crime rate has been rising. The characteristics of white-collar crime include: high level and status of criminal culture, high technique of crime means, strong concealment of criminal behavior, prominent organization of criminal activity, and obvious non-violent character of crime mode. The second chapter analyzes the causes of white-collar crime, we can see that white-collar crime is influenced by subjective and objective factors. Subjective aspects such as misplacement of life values, strong material desire and greedy motive, negative professional personality characteristics, objective aspects such as the impact of social impetuous psychology, weak crime control system, imperfect law enforcement and so on. The third chapter specially elaborates the white-collar culture and the white-collar crime question. Nowadays, white-collar culture has gradually deviated from the mainstream culture, which has become an important inducement of white-collar crime and brings difficulties to the investigation and handling of cases. therefore
