【摘要】： 毒品犯罪全球化問題已對(duì)人類的生存和發(fā)展構(gòu)成重大威脅。生產(chǎn)制造此類新型毒品犯罪的地域不斷擴(kuò)大,涉案地越來越復(fù)雜。應(yīng)積極加強(qiáng)與緬甸、老撾、泰國(guó)、菲律賓等國(guó)家的緝毒執(zhí)法合作。目前,犯罪分子使用的販毒手段極為隱蔽狡猾,人體內(nèi)藏毒、物體夾層藏毒等手段頻頻出現(xiàn)。在我國(guó),毒品犯罪導(dǎo)致家庭破裂、夫妻離異的情況非常普遍。對(duì)于毒品犯罪在我國(guó)的迅速蔓延,必須加強(qiáng)情報(bào)工作,通過各種情報(bào)來源,發(fā)現(xiàn)嫌疑線索,主動(dòng)尋找戰(zhàn)機(jī),打擊毒品犯罪。同時(shí)使用特殊的偵查手段來對(duì)付現(xiàn)代的毒品犯罪,強(qiáng)化毒品的情報(bào)工作,建立相應(yīng)的情報(bào)機(jī)構(gòu),形成完善的毒品情報(bào)處理的科學(xué)機(jī)制,以及時(shí)了解犯罪動(dòng)向,掌握工作的主動(dòng)權(quán)。毒品犯罪發(fā)展到今天,已形成全球性的種植、加工、走私、消費(fèi)的局面,僅僅憑借一國(guó)的力量緝毒是鞭長(zhǎng)莫及。我們應(yīng)對(duì)秘密打入的使用加以限制和規(guī)范,使之成為合法的偵查措施。從維護(hù)社會(huì)秩序,保障公共安全的角度出發(fā),只有犯罪具有足夠嚴(yán)重的社會(huì)危害性,合理運(yùn)用誘惑偵查這種偵查手段。建立合法的誘惑偵查制度。 本文主要涉及三部分內(nèi)容。第一部分是毒品犯罪的特點(diǎn),主要介紹毒品犯罪的集團(tuán)化、團(tuán)伙化、全球化、隱蔽化等特點(diǎn)。第二部分介紹了毒品犯罪的偵查對(duì)策,主要從宏觀和微觀兩個(gè)方面考慮,首先分析了毒品犯罪的專項(xiàng)偵查對(duì)策,從緝毒情報(bào)、秘密打入、誘惑偵查、跟蹤監(jiān)視、控制下交付等五個(gè)方面進(jìn)行分析；其次是宏觀偵查對(duì)策,主要從充分運(yùn)用秘密偵查手段、技術(shù)鑒定取證、強(qiáng)化情報(bào)工作、優(yōu)化偵查隊(duì)伍專業(yè)知識(shí)結(jié)構(gòu)、積極推進(jìn)禁毒合作等方面進(jìn)行闡述,這部分是本文的重點(diǎn)。第三部分是有關(guān)毒品犯罪偵查措施的立法完善,提出秘密打入和誘惑偵查的立法,主要從秘密打入的必要性、適用范圍、實(shí)體性要件、程序性要件,誘惑偵查的實(shí)施主體、適用范圍、適用對(duì)象、法律后果、法律救濟(jì)等方面進(jìn)行分析,完善毒品犯罪偵查措施的立法,積極打擊和預(yù)防毒品犯罪。
[Abstract]:The globalization of drug crime has posed a great threat to the survival and development of mankind. The region of producing and manufacturing this new drug crime is expanding, and the place of crime is becoming more and more complicated. We should actively strengthen law enforcement cooperation with Myanmar, Laos, Thailand, Philippines and other countries. At present, the drug trafficking methods used by criminals are extremely subtle and cunning. In our country, the drug crime causes the family to break up, the husband and wife divorce is very common. For the rapid spread of drug crime in our country, we must strengthen the intelligence work, through all kinds of information sources, find suspected clues, actively find fighter planes, crack down on drug crimes. At the same time, special investigative techniques are used to deal with modern drug crimes, to strengthen drug intelligence work, to establish corresponding intelligence agencies, and to form a perfect scientific mechanism for drug information processing, so as to keep abreast of the trends of crime. Master the initiative of the work. Drug crime has developed into a global situation of cultivation, processing, smuggling and consumption. We should limit and regulate the use of clandestine penetration to make it a legitimate investigative measure. From the angle of maintaining social order and ensuring public safety, only crime has serious social harmfulness. To establish a legal system of enticement investigation. This paper mainly involves three parts. The first part is the characteristics of drug crime, mainly introduces the characteristics of drug crime collectivization, gang, globalization, concealment and so on. The second part introduces the investigation countermeasures of drug crimes, mainly from the macro and micro aspects, first of all, analyzes the special investigation countermeasures of drug crimes, from anti-drug intelligence, secret infiltration, temptation detection, tracking surveillance, Five aspects of controlled delivery are analyzed, followed by macro investigation countermeasures, mainly from the full use of secret investigative techniques, technical identification and evidence collection, strengthening intelligence work, optimizing the professional knowledge structure of investigation teams, Actively promote drug-control cooperation and other aspects of the elaboration, this part is the focus of this article. The third part is about the legislative perfection of drug crime investigation measures, and puts forward the legislation of secret penetration and temptation investigation, mainly from the necessity, scope of application, substantive elements, procedural elements, the main body of the temptation investigation, mainly from the necessity of secret penetration, the scope of application, substantive elements, procedural elements, the main body of the temptation investigation.
