【摘要】： 隨著經(jīng)濟發(fā)展進程的加快及人民生活水平的日益提高，我國的機動車擁有量呈現(xiàn)幾何級數(shù)的增長。與此同時，盜竊機動車犯罪也日益猖獗，案件數(shù)量持續(xù)攀升，不僅給車主帶來了物質(zhì)損失和精神損害，同時也給國家，尤其是保險業(yè)帶來了巨大損失，并在一定程度上擾亂了機動車交易市場正常的交易秩序，利用被盜機動車進行其他犯罪活動的案件也不勝枚舉。鑒于盜竊機動車犯罪嚴重的社會危害，筆者認為有必要探索出行之有效的盜竊機動車犯罪的偵防對策，從而遏制此類犯罪的高發(fā)勢頭。因此，筆者從盜竊機動車案件的特點入手，深入分析盜竊機動車犯罪多發(fā)原因，并在此基礎(chǔ)上，立足盜竊機動車犯罪偵查面臨的主要問題，提出了此類犯罪偵查對策的完善。除此之外，筆者還對盜竊機動車犯罪的預(yù)防對策進行了研究，力求從各個角度、各個方面來探討預(yù)防此類犯罪的有效方法。全文分四個部分，主要內(nèi)容如下： 第一部分：盜竊機動車案件的特點。只有對案件特點進行認真研究，才能為采取相應(yīng)的偵查措施和對策提供依據(jù)和參考。本部分從犯罪時間、犯罪主體、犯罪客體、犯罪區(qū)域、犯罪手段、犯罪條件六個方面對此類案件的特點分別進行了闡述。具體說來，即犯罪時間多為夜間，，且作案時間短暫、逃離現(xiàn)場迅速；犯罪成員團伙化、組織嚴密、分工明確；作案目標高檔化，銷贓市場化；跨區(qū)域作案日益增多，經(jīng)濟發(fā)達地區(qū)為犯罪多發(fā)區(qū)域；犯罪手段多樣，有順手牽羊、偷配鑰匙、撬門別鎖、自制專用盜車工具、技術(shù)性作案等；犯罪條件特殊，涉及到盜、改、運、銷等多個環(huán)節(jié)，為我們重點防控和串并案件提供了可能。 第二部分：盜竊機動車犯罪多發(fā)原因分析。本部分從兩個方面對盜竊機動車犯罪多發(fā)的原因進行了分析。一方面是社會原因，另一方面是心理原因。具體而言，社會原因包括四個方面，即經(jīng)濟發(fā)展、車輛增多的物質(zhì)條件為犯罪分子提供了大量的作案目標，并為銷贓提供了市場；汽車保管場所少，保管制度不完善，安全設(shè)備落后，防盜性能差，車主防盜意識淡漠等因素導(dǎo)致社會治安管理滯后，整體防范意識淡��；地下交易市場的大量存在使機動車交易便捷，個別地區(qū)入戶管理不嚴，使贓車能夠保持其原有的使用價值；對盜車犯罪打擊不力，破案率較低，助長了犯罪分子的氣焰。心理原因則從偵查人員和犯罪分子兩個角度切入進行了分析。偵查人員偵查意識不強，心理倦怠、麻木，出現(xiàn)了“坐等案破”的現(xiàn)象；犯罪分子受拜金主義思潮影響，產(chǎn)生了經(jīng)濟需要，貧富差距又使得犯罪分子認為自己是社會的受害者，犯罪心理合理化，經(jīng)濟需要與犯罪心理合理化就成了促使他們犯罪的動因。 第三部分：盜竊機動車偵查對策研究。本部分先闡述了盜竊機動車案件偵查所面臨的主要問題，在此基礎(chǔ)上，有針對性的提出了盜竊機動車犯罪偵查對策的完善。在案件偵查所面臨的問題方面，主要包括破案率低、刑偵基礎(chǔ)工作差、辦案經(jīng)費保障難以到位、信息不暢、刑偵協(xié)作機制不完善五個方面。破案率低使民眾安全感下降，犯罪分子僥幸心理增強；刑偵基礎(chǔ)工作差則表現(xiàn)在陣地控制、刑嫌控制、犯罪情報信息建設(shè)三個方面；辦案經(jīng)費的不足及相關(guān)保障難以到位極大的制約了公安機關(guān)偵查工作的開展：信息不暢則表現(xiàn)為發(fā)案信息不暢、破案信息不暢、車輛信息不暢、并案信息不暢、抓獲嫌疑人信息不暢、追逃信息不暢等；刑偵協(xié)作機制不完善包括各警種缺乏有效配合、區(qū)域性偵查協(xié)作不完善兩個方面。在偵查對策的完善部分，則是從四個方面進行了闡述。一是建立高素質(zhì)的盜竊機動車專案偵查隊伍，要注意三個問題，即要有強大的技術(shù)力量作支持；要有精通偵查破案的業(yè)務(wù)能力；要有良好的心理素質(zhì)。二是加強相關(guān)管理，包括五個方面的內(nèi)容，即適時開展專項斗爭；加強涉車管理；建立道路車輛監(jiān)管系統(tǒng)；完善刑偵基礎(chǔ)工作；加強偵查協(xié)作。三是充分利用科學(xué)技術(shù)，做到偵技結(jié)合，通過對電子眼、計算機及網(wǎng)絡(luò)技術(shù)、GPS衛(wèi)星定位系統(tǒng)、驗證和顯現(xiàn)號碼技術(shù)的簡要介紹，探討它們的有效利用方式。四是完善相關(guān)涉車信息，建立涉車信息庫，并將全國涉車信息庫與交通信息系統(tǒng)融為一體。 第四部分：盜竊機動車預(yù)防對策研究。此部分分為專門預(yù)防、社會預(yù)防、情境預(yù)防三個方面。專門預(yù)防包括警察預(yù)防、管理預(yù)防、司法預(yù)防。要使警察預(yù)防真正發(fā)揮其效能，一方面要加大打擊犯罪的力度，另一方面要強化各警種的防范職能，在諸項治安管理活動中產(chǎn)生整和效應(yīng)。管理預(yù)防則是要加強道路交通管理、道路車輛管理及停車業(yè)的治安管理。司法預(yù)防則要做到“有法可依、有法必依、執(zhí)法必嚴、違法必究”。社會預(yù)防包括群眾預(yù)防、企業(yè)預(yù)防。群眾預(yù)防是社會治安防范的主體，要使群眾提高防盜意識，掌握防盜常識，并發(fā)揮物業(yè)保安等群眾性安全防范組織的重要作用。企業(yè)預(yù)防將市場機制引入了犯罪預(yù)防體系，是對社會治安管理職能的補充，是建立并發(fā)展多元化的社會治安防范體系的需要。情境預(yù)防則是通過目標強化保護、降低犯罪收益、減少犯罪刺激、正式監(jiān)控、環(huán)境設(shè)計、鄰里守望六個方面，持久有機地改變犯罪環(huán)境，盡可能的使行為人認識到犯罪行為難度增加，被捕可能性增大，犯罪收益減少，以此來減少犯罪。本部分與第三部分是全文之重點。
[Abstract]:With the accelerating process of economic development and the increasing living standards of the people, the number of motor vehicles in China has been increasing geometrically. At the same time, the crime of theft of motor vehicles is increasingly rampant and the number of cases is rising, which not only brings material loss and mental damage to the owners, but also brings to the state, especially the insurance industry. Huge losses, and to a certain extent, disrupted the normal order of the trading market in motor vehicles, and there are numerous cases of using stolen motor vehicles for other criminal activities. In view of the serious social harm of the theft of motor vehicles, the author thinks it is necessary to explore effective measures to detect and prevent the crime of stealing motor vehicles. Therefore, from the characteristics of the theft of motor vehicle cases, the author analyzes the reasons for the crime of theft of motor vehicles, and based on this, based on the main problems of the crime investigation of the theft of motor vehicles, and puts forward the improvement of this kind of crime investigation. In addition, the author also prevents the crime of theft of motor vehicles. The countermeasures are studied, and the effective ways to prevent such crimes are discussed from various angles and aspects. The full text is divided into four parts. The main contents are as follows:
The first part: the characteristics of the case of theft of motor vehicles. Only by careful study of the characteristics of the case can we provide the basis and reference for the corresponding investigation measures and countermeasures. This part expounds the characteristics of such cases from six aspects: the time of crime, the subject of the crime, the object of the crime, the area of the crime, the means of crime and the conditions of the crime. In particular, the crime time is more night, and the time of the crime is short, fleeing the scene quickly; the criminal members are ganged up, the organization is strict, the division of labor is clear; the crime target is upscale, the market of the stolen goods is marketed; the trans regional case is increasing, the economically developed areas are more crime areas; the crime means are varied, the key is stolen, the door prizes the door. Do not lock, the self-made special theft vehicle tools, technical crime, and so on; the criminal conditions are special, involving many links, such as theft, modification, transportation and marketing, which provide the possibility for our key prevention and control and cases.
The second part: analysis of the reasons for the multiple crime of theft of motor vehicles. This part analyses the reasons for the multiple crimes of theft of motor vehicles from two aspects. One is the social reasons and the other is psychological reason. In particular, the social reasons include four aspects, that is, the economic development, and the material conditions for the increase of vehicles provide the criminals. A large number of targets, and provide a market for the sale of stolen goods; less storage places in the car, imperfect safekeeping system, backward security equipment, poor anti-theft performance, poor security awareness and other factors led to the social security management lag, the overall awareness of light; the large number of existence of the underground trading market makes motor vehicle transactions convenient, individual areas into households Management is not strict, so that the stolen car can maintain its original use value; the crime against car theft is ineffective, the rate of breaking the case is low, and encourages the spirit of the criminals. Psychological reasons are analyzed from the two angles of investigators and criminals. The criminals are influenced by the thought of the money worship, and the economic needs are created. The gap between the rich and the poor makes the criminals think that they are the victims of the society, the criminal psychology is rationalized, the economic needs and the rationalization of the criminal psychology become the motivations for them to commit crimes.
The third part: the investigation of the detection of theft of motor vehicles. This part first expounds the main problems faced by the investigation of the theft of motor vehicles. On this basis, it puts forward the improvement of the detection countermeasures for the crime of theft of motor vehicles. In the case of the problems facing the case investigation, the main problem is to include the low rate of breaking the case, the poor basic work of criminal investigation and the case of handling cases. The financial guarantee is difficult to be put in place, the information is not smooth and the criminal investigation cooperation mechanism is not perfect in five aspects. The low breaking rate makes the people's sense of security decline and the criminals' fluke psychological enhancement; the poor basic work of criminal investigation is shown in three aspects: position control, punishment control, and criminal information information construction; the shortage of funds for handling cases and related guarantee is difficult to be in place extremely. Including five aspects, that is to carry out the special struggle in time, strengthen the management of the vehicle involved, establish the supervision system for road vehicles, improve the basic work of criminal investigation, and strengthen the cooperation of investigation. Three is to make full use of science and technology to achieve the combination of detection and technology, and through the electronic eye, computer and network technology, GPS satellite positioning system, verification and display number technology. A brief introduction is made to discuss the effective use of them. Four is to improve the relevant information related to the vehicle, to establish a car related information base, and to integrate the national vehicle information base with the traffic information system.
The fourth part: Research on the prevention of theft of motor vehicles. This part is divided into three aspects: special prevention, social prevention and situation prevention. The special prevention includes the prevention of police, management and prevention, and judicial prevention. In order to make the police prevent the real use of its effectiveness, on the one hand, we should strengthen the efforts to combat crime, and on the other hand, strengthen the guard function of all kinds of police. The management prevention is to strengthen the road traffic management, the road vehicle management and the public security management of the parking industry. The judicial prevention should be "there are laws to abide by, law must be carried out, law enforcement must be strict, illegal investigation". Social prevention includes mass prevention, enterprise prevention. Mass prevention is social security prevention. The main body of fan should make the masses improve the awareness of burglar theft, grasp the common sense of burglar theft, and play the important role of the mass security organizations such as the property security. The enterprise prevention has introduced the market mechanism to the crime prevention system. It is a supplement to the social security management function and the need for the establishment and development of a diversified social security guard system. The prevention is by strengthening the protection of the target, reducing the crime income, reducing the crime stimulation, the formal monitoring, the environmental design, the neighborhood watch six aspects, the persistent organic change of the criminal environment, as far as possible to make the perpetrator realize the increase in the difficulty of the crime, the increase of the possibility of the arrest, the decrease of the income of the crime, so as to reduce the crime.
