【摘要】： 20世紀80年代中期以后,未成年人犯罪日益嚴重,集中表現(xiàn)在犯罪人數(shù)整體呈階段性上升、犯罪性質(zhì)及社會危害性日趨嚴重、犯罪類型不斷增多、結(jié)伙作案突擊、犯罪低齡化等幾個方面,這要求我們共同為保護未成年人、拯救失足未成年人而努力。 未成年人犯罪日益嚴重并不能否定綜合治理作為社會治安基本方針的正確性。本文第一章通過從理論上分析犯罪原因的復雜、交錯、變化,從實踐上分析我國綜合治理所取得的成效,從建國以來犯罪的動態(tài)變化分析綜合治理的適應性與超前性,論證了綜合治理是科學有效的、有針對性的減少、預防、治理未成年人犯罪的戰(zhàn)略思想和對策。第二章系統(tǒng)地闡述了綜合治理是黨領(lǐng)導人民長期同犯罪作斗爭的歷史經(jīng)驗總結(jié),是黨推動下逐漸完善和成熟起來的科學的預防犯罪方略。在新的歷史時期,綜合治理通過《未成年人保護法》、《預防未成年人犯罪法》的頒布實施實現(xiàn)了“治理”與“保護”的辯證統(tǒng)一。 綜合治理作為預防犯罪的基本方針、基本途徑、基本方法無疑是正確的,但未成年人犯罪的嚴重性卻揭示出綜合治理體系面臨困難和存在問題,需要我們認真反思并加以完善。本文第三章至第五章著重從立法、制度機制及組織機構(gòu)、社會支持體系等方面闡述未成年人犯罪綜合治理體系中存在的問題,包括未成年人立法意識落后、法律制度的設計存在缺陷、立法操作性不強、立法尚未實現(xiàn)體系化;綜合治理工作機制尚未法制化、規(guī)范化、尚未建立權(quán)威的、多功能的指揮協(xié)調(diào)機構(gòu)、矯治制度不科學、司法機構(gòu)建設落后;家庭教育功能不良和缺失、學校教育存在“功利”趨向、社區(qū)教育乏力等。第六章則針對存在的問題有針對性地提出完善對策,包括樹立未成年人保護意識和“四大”體系的構(gòu)建:未成年人法律規(guī)范體系、綜合治理機構(gòu)體系、司法保護體系、社會支持體系。 文章最后指出犯罪和未成年人犯罪的綜合治理是在一系列中國化了的馬克思主義理論指導下逐漸形成、發(fā)展、完善、成熟起來的,需要在預防犯罪的實踐中不斷創(chuàng)新、總結(jié)、完善。
[Abstract]:Since the mid-1980s, juvenile delinquency has become more and more serious, which is mainly reflected in the overall increase in the number of crimes, the increasingly serious nature of crime and social harmfulness, the increasing number of crime types, and the assault of gang crime. This requires us to work together to protect minors and save underage minors. The growing seriousness of juvenile delinquency cannot deny the correctness of comprehensive management as the basic policy of social security. The first chapter of this paper analyzes the complexity, crisscross and change of the causes of crime theoretically, analyzes the achievements of comprehensive management in practice, and analyzes the adaptability and advance of comprehensive management from the dynamic changes of crime since the founding of the people's Republic of China. This paper demonstrates that comprehensive management is scientific and effective, and the strategic thoughts and countermeasures of reducing, preventing and controlling juvenile delinquency are pointed out. The second chapter systematically expounds that comprehensive management is the historical experience of the Party leading the people to fight against crime for a long time, and is a scientific crime prevention strategy gradually perfected and matured by the Party. In the new historical period, the comprehensive management has realized the dialectical unity of "governance" and "protection" through the promulgation and implementation of the Law on the Protection of minors and the Law on the Prevention of Juvenile Delinquency. As the basic policy of crime prevention, comprehensive management is undoubtedly correct, but the seriousness of juvenile delinquency reveals that the comprehensive management system is facing difficulties and existing problems, which requires us to reflect on and perfect it. The third to fifth chapters focus on the problems existing in the comprehensive management system of juvenile delinquency from the aspects of legislation, institutional mechanism, organization and social support system, including the backward consciousness of juvenile legislation. The design of the legal system is flawed, the legislative operation is not strong, the legislation has not yet been systematized, the working mechanism of comprehensive management has not yet been legalized, standardized, authoritative and multi-functional command and coordination organizations have not been established, and the system of correction is not scientific. The construction of judicial institution is backward, the function of family education is poor and lacking, the tendency of "utility" exists in school education, and the community education is weak. The sixth chapter puts forward the perfect countermeasures against the existing problems, including the establishment of the consciousness of protection of minors and the construction of the "four major" systems: the system of legal norms for minors, the system of comprehensive governance institutions, and the system of judicial protection. Social support system Finally, the article points out that the comprehensive management of crime and juvenile crime is gradually formed, developed, perfected and matured under the guidance of a series of Sinicized Marxist theories, and needs to be continuously innovated and summarized in the practice of crime prevention.
