【摘要】：我國大陸地區(qū)在經(jīng)歷25年(1953～1978)的歷史空白之后，具有大陸地區(qū)特色的黑社會(huì)性質(zhì)犯罪死灰復(fù)燃。一方面，境內(nèi)黑社會(huì)性質(zhì)犯罪的孳生；另一方面，境外黑社會(huì)的滲透，這兩股黑社會(huì)勢(shì)力在大陸地區(qū)以其特有的有組織暴力的超犯罪能量嚴(yán)重破壞了一地區(qū)或行業(yè)的經(jīng)濟(jì)和社會(huì)生活秩序，動(dòng)搖了社會(huì)群體對(duì)國家的信任，給公眾心理上造成一種邪惡當(dāng)?shù)�，正義不存的錯(cuò)覺。因此，打擊黑社會(huì)性質(zhì)犯罪成為我國刑偵的重要迫切的任務(wù)之一。為了更有效地打擊黑社會(huì)性質(zhì)犯罪，本文將深入探討黑社會(huì)性質(zhì)基本理論以及打擊黑社會(huì)性質(zhì)犯罪的偵查對(duì)策，以期對(duì)刑偵工作有所啟發(fā)。 本文共分三部分，約35，000字。 第一部分：概述。本部分從不同側(cè)面探討了兩組概念：黑社會(huì)性質(zhì)組織和黑社會(huì)性質(zhì)犯罪。并且進(jìn)一步區(qū)分了兩組概念：黑社會(huì)性質(zhì)組織和黑社會(huì)組織，黑社會(huì)性質(zhì)組織與犯罪集團(tuán)、犯罪團(tuán)伙。 第二部分：介紹當(dāng)代中國(大陸地區(qū))黑社會(huì)性質(zhì)犯罪的基本特點(diǎn)。本部分著重從我國大陸地區(qū)黑社會(huì)性質(zhì)犯罪的手段的殘暴性，組織形式的落后性，成員結(jié)構(gòu)的邊沿性，組織活動(dòng)的地域性，境外黑社會(huì)的滲透性，保護(hù)傘的地域性六個(gè)方面介紹我國大陸地區(qū)黑社會(huì)性質(zhì)犯罪的特點(diǎn)。 第三部分：我國黑社會(huì)性質(zhì)犯罪偵查對(duì)策。本部分著重從五個(gè)方面探討反黑對(duì)策，，即反黑領(lǐng)導(dǎo)機(jī)制的建立，反黑專業(yè)小組的建立，反黑證據(jù)收集，秘密偵查手段的合理運(yùn)用以及反黑國際合作。
[Abstract]:After 25 years (19531978) of historical blank in the mainland of China, the underworld crime with the characteristics of the mainland has come back to life. On the one hand, the growth of triad crimes in the territory; on the other hand, the infiltration of underworld societies abroad, These two underworld forces in the mainland have seriously damaged the economic and social order of a region or an industry and shaken the trust of social groups in the state with their unique energy of super criminal organized violence. To the public psychologically create an evil situation, justice does not exist in the illusion. Therefore, cracking down on underworld crimes has become one of the important and urgent tasks of criminal investigation in China. In order to crack down on the crime of underworld character more effectively, this article will deeply discuss the basic theory of underworld nature and the investigation countermeasure of cracking down on underworld crime, in order to enlighten the work of criminal investigation. This article is divided into three parts, about 35000 words. Part I: Overview. This part discusses two groups of concepts from different aspects: underworld organization and underworld crime. And further distinguish two groups of concepts: underworld organization and underworld organization, underworld organization and criminal group, criminal gang. The second part: introduces the basic characteristics of the underworld crime in contemporary China (mainland China). This part focuses on the cruelty of the means, the backwardness of the organizational form, the edge of the membership structure, the regional nature of the organization activities, and the penetration of the overseas underworld in the mainland of China. The regional nature of umbrella introduces the characteristics of underworld crime in mainland China. The third part: our country underworld nature crime investigation countermeasure. This part focuses on five aspects of anti-triad countermeasures, namely, the establishment of anti-triad leadership mechanism, the establishment of anti-triad professional group, anti-criminal evidence collection, the rational use of secret investigative techniques and anti-criminal international cooperation.
