【摘要】： 隨著世界各國(guó)行刑社會(huì)化的不斷發(fā)展,社區(qū)矯正制度在西方主要發(fā)達(dá)國(guó)家和我國(guó)港臺(tái)地區(qū)已經(jīng)成為一種主要刑罰執(zhí)行方式。順應(yīng)這一趨勢(shì),中國(guó)大陸目前己有18個(gè)省、市、自治區(qū)開(kāi)展了社區(qū)矯正的試點(diǎn)。由于這一制度畢竟在我國(guó)剛剛起步,無(wú)論在理論上還是實(shí)踐中都沒(méi)有形成一套成熟的模式,因此試點(diǎn)中不可避免地出現(xiàn)了一些問(wèn)題,其中最突出的就是矯正對(duì)象正當(dāng)資源和權(quán)利的被剝奪而導(dǎo)致他們處于一種“失權(quán)”的狀態(tài),并且這種“失權(quán)”在一定程度成為了矯正工作深入開(kāi)展的障礙。 針對(duì)這種情況,本文在借鑒英、美等發(fā)達(dá)國(guó)家矯正工作經(jīng)驗(yàn)的基礎(chǔ)上,明確提出了我國(guó)目前青少年罪犯社區(qū)矯正制度的發(fā)展完善途徑,即將社會(huì)工作的價(jià)值理念和方法應(yīng)用于社區(qū)矯正,實(shí)現(xiàn)兩者的有機(jī)結(jié)合。筆者從社會(huì)工作的“增權(quán)”理論入手,結(jié)合社會(huì)學(xué)、犯罪學(xué)等相關(guān)知識(shí),依據(jù)上海、江蘇等地的實(shí)踐經(jīng)驗(yàn),運(yùn)用文獻(xiàn)法和實(shí)證調(diào)查綜合分析法,對(duì)“社會(huì)工作如何介入青少年罪犯的社區(qū)矯正”這一課題進(jìn)行探討。 文章在探討我國(guó)青少年罪犯社區(qū)矯正制度不足的基礎(chǔ)上,打破傳統(tǒng)的矯正觀念,提出了一系列帶有科學(xué)、前衛(wèi)精神的矯正措施、方法和對(duì)策。強(qiáng)調(diào)運(yùn)用社會(huì)工作的理念與方法并對(duì)它們進(jìn)行本土化改造;矯正工作者從矯正對(duì)象自身的認(rèn)知、情緒問(wèn)題、人際關(guān)系等方面存在的不足和缺陷入手;運(yùn)用小組、個(gè)案、社區(qū)三大專(zhuān)業(yè)工作方法,調(diào)動(dòng)社會(huì)資源,打開(kāi)存在于矯正對(duì)象自身人格中的力量之源,積極地從外部推動(dòng)矯正對(duì)象的增權(quán),進(jìn)而恢復(fù)其社會(huì)功能。
[Abstract]:With the continuous development of the socialization of execution in all countries in the world, the system of community correction has become a major penalty execution mode in the major western developed countries and the Hong Kong and Taiwan areas in the West. Conforming to this trend, the Chinese mainland has 18 provinces, cities and autonomous regions have carried out the pilot of community correction. Since this system has just started in China after all, it has just started in China. No matter in theory or practice, no mature model has been formed, so some problems inevitably arise in the pilot. The most outstanding one is the deprivation of the right resources and rights of the corrected object, which leads them to be in a state of "losing power", and this "loss of power" has become Jiao Zhenggong to a certain extent. In view of this, on the basis of the experience of the correction work in the developed countries such as Britain and the United States, this paper puts forward a clear way for the development and perfection of the community correction system for juvenile offenders in our country, which is to apply the values and methods of social work to community correction and realize the organic combination of the two. The author's "power to increase" from the social work. Based on the theory of sociology, Criminology and other related knowledge, according to the practical experience of Shanghai, Jiangsu and other places, the paper discusses the subject of "how social work is involved in the community correction of juvenile offenders" by using the literature method and the comprehensive analysis method of empirical investigation.
On the basis of discussing the shortage of community correction system for juvenile delinquents in China and breaking the traditional correction concept, this paper puts forward a series of corrective measures, methods and Countermeasures with science and avant-garde spirit, emphasizing the idea and method of applying social work and reconstructing them, and the correction workers' cognition from the corrected objects themselves, The shortcomings and defects of emotional problems and interpersonal relationships are found. Using three major methods of professional work in groups, cases and communities, mobilizing social resources, opening the source of strength existing in the personality of the corrected objects, actively promoting the right to increase the correct object from the outside, and then restoring its social function.
