【摘要】：職務(wù)犯罪作為中外世界各國(guó)非常重視的一類犯罪，在社會(huì)主義市場(chǎng)經(jīng)濟(jì)高速發(fā)展的同時(shí)，職務(wù)犯罪卻進(jìn)入多發(fā)期。這不僅嚴(yán)重影響了黨和政府在群眾心目中的形象,造成了巨大的經(jīng)濟(jì)損失，而且還破壞了和諧社會(huì)的有序發(fā)展，甚至有可能威脅到國(guó)家政權(quán)的穩(wěn)固。因此，在這種形勢(shì)下研究職務(wù)犯罪就顯得很有必要。 本文立足Z區(qū)從多方面對(duì)職務(wù)犯罪作了探討。全文共分四個(gè)部分，內(nèi)容如下： 第一部分從實(shí)際出發(fā)，介紹了貴州省Z區(qū)檢察院近年來(lái)查辦的職務(wù)犯罪的基本情況，，并對(duì)該區(qū)職務(wù)犯罪的現(xiàn)狀、作案手段以及犯罪特點(diǎn)進(jìn)行了分析。 第二部分著重從該地區(qū)職務(wù)犯罪的主客觀兩個(gè)方面對(duì)職務(wù)犯罪的成因進(jìn)行了闡述。 第三部分對(duì)職務(wù)犯罪的社會(huì)危害性進(jìn)行了分析，指出職務(wù)犯罪致使政府公信力下降，阻礙經(jīng)濟(jì)發(fā)展，對(duì)社會(huì)環(huán)境及風(fēng)氣的影響非常惡劣，造成腐敗現(xiàn)象的惡性循環(huán)，危及地區(qū)社會(huì)的穩(wěn)定。 第四部分是關(guān)于懲治預(yù)防職務(wù)犯罪的建議與對(duì)策�；趹椭魏皖A(yù)防職務(wù)犯罪的一般規(guī)律和Z區(qū)職務(wù)犯罪的形勢(shì)和特點(diǎn)，提出了相應(yīng)的對(duì)策：建立高薪養(yǎng)廉、行業(yè)預(yù)防、風(fēng)險(xiǎn)提醒制度；思想上的建設(shè)，做好“內(nèi)因警示”，防止權(quán)力異化；完善監(jiān)督，堵住“漏洞”，防止“一把手”和重點(diǎn)崗位人員腐��；司法措施的完善；深化干部人事制度改革；重點(diǎn)防控煤炭行業(yè)職務(wù)犯罪。
[Abstract]:Job-related crime, as a kind of crime which is attached great importance to in the world, has entered a period of frequent occurrence while the socialist market economy is developing at a high speed. This has not only seriously affected the image of the Party and government in the eyes of the masses, caused enormous economic losses, but also destroyed the orderly development of a harmonious society, and may even threaten the stability of the state power. Therefore, it is necessary to study duty crime in this situation. Based on Z region, this paper probes into duty crime from many aspects. The full text is divided into four parts: the first part introduces the basic situation of duty crime investigated by the Z District Procuratorate of Guizhou Province in recent years, and the present situation of duty crime in this area. The crime means and the characteristics of the crime were analyzed. The second part mainly expounds the causes of duty crime from two aspects: subjective and objective. The third part analyzes the social harmfulness of job-related crimes, points out that job-related crimes lead to the decline of the credibility of the government, hinder economic development, the impact on the social environment and ethos is very bad, resulting in a vicious circle of corruption. Endanger the stability of regional society. The fourth part is about the prevention duty crime suggestion and the countermeasure. Based on the general law of punishing and preventing duty crime and the situation and characteristics of duty crime in Z area, the corresponding countermeasures are put forward: establishing the system of keeping clean with high salary, preventing industry, reminding risk, constructing thought, doing well "warning of internal cause", To prevent power alienation; to perfect supervision, to plug "loopholes", to prevent corruption of "top leaders" and key posts; to perfect judicial measures; to deepen the reform of cadre and personnel system; and to focus on preventing and controlling crimes committed by the coal industry.
