【摘要】：青少年犯罪在整個(gè)刑事犯罪中占有一定比例,25歲以下的青少年在其中扮演著“重要角色”。近幾年比例雖有所下降,但青少年犯罪的絕對(duì)人數(shù)仍在增加,嚴(yán)重程度不斷升級(jí),暴力型犯罪比例越來(lái)越高。由此可見(jiàn),我國(guó)青少年違法犯罪問(wèn)題在一定程度上已經(jīng)影響到了社會(huì)的治安和穩(wěn)定,預(yù)防、控制和消除青少年違法犯罪已刻不容緩。但是要根本解決青少年犯罪問(wèn)題,則必須了解青少年犯罪的原因。為此,人們對(duì)它進(jìn)行了艱難的探索,以求通過(guò)找出原因而找到預(yù)防和控制及消除青少年犯罪的良方。 犯罪原因是一個(gè)系統(tǒng),是一個(gè)多層次的、綜合的、變化的、彼此互為作用的相關(guān)系統(tǒng),它包含有社會(huì)、心理、生理、自然環(huán)境以及文化等多種因素。這諸多因素有機(jī)結(jié)合而形成一定的罪因結(jié)構(gòu)時(shí),便可能導(dǎo)致某種犯罪現(xiàn)象的發(fā)生。同時(shí)青少年犯罪的原因具有復(fù)雜性特點(diǎn),在其產(chǎn)生犯罪的過(guò)程中,很多因素(家庭、學(xué)校、社會(huì)、經(jīng)濟(jì)、文化等),作為一種客觀的生活環(huán)境強(qiáng)制地作用于他,可以說(shuō)是一個(gè)原因鏈或原因群在作用其上。而且青少年違法犯罪行為與原因之間的關(guān)系也是復(fù)雜的,一方面青少年的某種違法犯罪行為,可能是多種原因作用的結(jié)果;另一方面,某一種具體的原因又可能誘發(fā)青少年的多種違法犯罪行為。青少年要從個(gè)體的人成為現(xiàn)實(shí)社會(huì)的人,必須經(jīng)過(guò)社會(huì)化,文化是其社會(huì)化的基本前提,也是其步入社會(huì)的起點(diǎn)。不可否認(rèn),在青少年違法犯罪的諸多原因中,文化無(wú)疑是直接或間接誘發(fā)青少年違法犯罪的重要根源。本文從文化的視角對(duì)青少年犯罪進(jìn)行了成因研究,論述了文化對(duì)于青少年社會(huì)化的影響及不良文化對(duì)于青少年犯罪的影響。 文化可以使青少年了解并接受符合社會(huì)要求的行為規(guī)范,使青少年認(rèn)同
[Abstract]:Juvenile delinquency plays an important role in the whole criminal offence. Although the proportion of juvenile delinquency has decreased in recent years, the absolute number of juvenile delinquents is still increasing, the severity is escalating, and the proportion of violent crimes is increasing. It can be seen that the problem of juvenile delinquency in our country has affected the public order and stability to a certain extent, so it is urgent to prevent, control and eliminate juvenile delinquency. But in order to solve the problem of juvenile delinquency, we must understand the reasons of juvenile delinquency. Therefore, people have carried on the difficult exploration to find out the cause to find out the prevention, control and elimination of juvenile delinquency. The cause of crime is a system, a multi-level, comprehensive, changing, interactive related system, which includes social, psychological, physiological, natural environment and culture and other factors. When these factors combine organically to form a certain structure of crime, it may lead to the occurrence of some kind of crime phenomenon. At the same time, the causes of juvenile delinquency are characterized by complexity. In the process of producing the crime, many factors (family, school, society, economy, culture, etc.) act on him as an objective living environment. It can be said that a chain of causes or a group of causes on its action. Moreover, the relationship between juvenile delinquency and its causes is also complex. On the one hand, some juvenile delinquency may be the result of various causes; on the other hand, A specific cause may induce a variety of juvenile delinquency. Teenagers must go through socialization if they want to change from individual person to real society. Culture is the basic premise of socialization and the starting point of society. There is no denying that culture is an important source of inducing juvenile delinquency directly or indirectly among the many reasons of juvenile delinquency. This paper studies the causes of juvenile delinquency from the perspective of culture, and discusses the influence of culture on the socialization of teenagers and the influence of bad culture on juvenile delinquency. Culture enables adolescents to understand and accept norms of behaviour that meet social requirements and enable them to identify with them
