論中國勞動教養(yǎng)制度缺陷與改革

【摘要】:勞動教養(yǎng)制度是中國特有的法律制度,它在過去的58年里,為維護社會治安秩序和社會穩(wěn)定發(fā)揮了一定的歷史作用。但隨著社會政治、經濟、法制的發(fā)展變化,勞動教養(yǎng)制度缺乏足夠的法律依據以及權力制約等問題也凸顯出來,改革、廢除勞動教養(yǎng)制度的呼聲也越來越強烈,并已成為學術界研究的熱點問題。本文首先對勞動教養(yǎng)制度進行了概述,通過分析勞動教養(yǎng)制度在實體和程序上存在的缺陷,闡釋勞動教養(yǎng)制度存在問題的根源所在。其次,筆者從國家對人權的注重及法制建設發(fā)展要求入手,分析勞動教養(yǎng)制度改革的必要性。最后,在肯定勞動教養(yǎng)制度改革的必要性同時,提出對其進行全面改革的具體措施。 具體而言,,本文除引言、結語外共包括以下四個部分: 第一部分:勞動教養(yǎng)制度概述。本部分對我國勞動教養(yǎng)的概念、特征、歷史、勞動教養(yǎng)的對象及期限、勞動教養(yǎng)案件的辦理程序,以及勞動教養(yǎng)與刑罰、治安管理處罰的關系等內容作了較為詳盡的闡述。 第二部分:勞動教養(yǎng)制度的缺陷與存廢爭議。本部分分為兩方面,一是勞動教養(yǎng)制度存在的實體問題和程序問題,二是闡述學術界存在的勞動教養(yǎng)存廢問題的爭論。 第三部分:勞動教養(yǎng)制度改革必要性分析。本部分從兩個方面論證勞動教養(yǎng)改革的必要性,一是國家對人權的注重要求勞動教養(yǎng)必須改革;二是法制建設發(fā)展要求勞動教養(yǎng)制度必須改革。 第四部分:重構勞動教養(yǎng)制度價值理念與具體改革措施。本部分提出對勞動教養(yǎng)的改革不僅要在措施上進行改革,對其價值理念也應進行重構。
[Abstract]:The system of reeducation through labor is a unique legal system in China. It has played a historical role in maintaining public order and social stability in the past 58 years. However, with the development and changes of social politics, economy and legal system, the lack of sufficient legal basis for the re-education through labour system and the restriction of power, and so on, the voice of reform and abolition of the system of re-education through labour has become more and more intense. And has become a hot issue in academic research. This paper first summarizes the system of re-education through labor, through the analysis of the defects of the system in substance and procedure, explains the root of the existing problems in the system of re-education through labor. Secondly, the author analyzes the necessity of the reform of reeducation through labor system from the point of view of the state's emphasis on human rights and the requirements of the development of legal construction. Finally, the necessity of the reform of reeducation through labor system is affirmed, and the concrete measures for its overall reform are put forward. Specifically, in addition to the introduction, the conclusion consists of the following four parts: Part one: summary of reeducation through labor system. In this part, the concept, characteristics, history, object and time limit of reeducation through labor, the procedure of dealing with the case, the relation between reeducation through labor and punishment, the punishment of public security management and so on are elaborated in detail. The second part: the defect of reeducation through labor system and the dispute of retention and abolition. This part is divided into two aspects, one is the substantive problems and procedural problems in the system of re-education through labor, the other is the debate about the existence of reeducation through labor and abolition in academic circles. The third part: the necessity analysis of the reform of reeducation through labor system. This part demonstrates the necessity of reeducation through labor reform from two aspects: one is that the state pays attention to human rights and the other is that the development of legal system requires the reform of reeducation through labor system. The fourth part: reconstructing the value idea of reeducation through labor system and concrete reform measures. This part puts forward that the reform of reeducation through labor should not only reform in measures, but also reconstruct its value concept.
