【摘要】： 黑社會(huì)性質(zhì)組織犯罪不僅僅是一個(gè)犯罪問題，更是一個(gè)社會(huì)問題。近年來，黑社會(huì)性質(zhì)組織犯罪在我國(guó)呈現(xiàn)出日趨泛濫的態(tài)勢(shì)，嚴(yán)重破壞了我國(guó)社會(huì)秩序和生產(chǎn)生活秩序，也為我國(guó)刑法理論界和司法實(shí)踐部門所關(guān)注。但是由于各方面原因，司法實(shí)踐中對(duì)黑社會(huì)性質(zhì)組織的認(rèn)定一直存在困惑，刑法理論界亦無統(tǒng)一認(rèn)識(shí)。作為一種有組織犯罪，黑社會(huì)性質(zhì)犯罪不僅具有獨(dú)特的行為特征，其防范和控制對(duì)策與其他一般團(tuán)伙犯罪、黑社會(huì)犯罪等也有較大的區(qū)別。 本文針對(duì)如何認(rèn)定黑社會(huì)性質(zhì)組織犯罪，試從黑社會(huì)性質(zhì)組織犯罪的概念、特征為起點(diǎn)，分析了我國(guó)黑社會(huì)性質(zhì)組織犯罪的形成原因和發(fā)展態(tài)勢(shì)，并對(duì)其防范對(duì)策作粗略的分析，認(rèn)為建立具有法治性、特殊性、綜合性的控制體系是防范黑社會(huì)性質(zhì)組織犯罪的理性選擇。 本文從結(jié)構(gòu)上分為三章，共三萬余字。 第一章，黑社會(huì)性質(zhì)組織犯罪概述。黑社會(huì)性質(zhì)組織與黑社會(huì)性質(zhì)組織犯罪是兩個(gè)不同的概念。本章從黑社會(huì)性質(zhì)組織的概念、特征入手，介紹了黑社會(huì)性質(zhì)組織與相關(guān)犯罪組織，如“黑惡勢(shì)力”、犯罪集團(tuán)、黑社會(huì)組織、恐怖組織等之間的區(qū)別。再從犯罪組織深入到犯罪行為，對(duì)黑社會(huì)性質(zhì)組織犯罪的概念進(jìn)行了界定。 第二章，我國(guó)黑社會(huì)性質(zhì)組織犯罪形成的原因和發(fā)展態(tài)勢(shì)。從歷史根源、經(jīng)濟(jì)因素、社會(huì)因素、政治因素、外來因素等五個(gè)方面進(jìn)行分析，簡(jiǎn)單指出我國(guó)黑社會(huì)性質(zhì)組織犯罪的形成原因。同時(shí)，結(jié)合當(dāng)前不斷變化的犯罪現(xiàn)狀，對(duì)我國(guó)黑社會(huì)性質(zhì)組織犯罪的發(fā)展態(tài)勢(shì)進(jìn)行了預(yù)測(cè)：在未來的一段時(shí)間內(nèi)，我國(guó)從現(xiàn)在的“黑社會(huì)性質(zhì)組織犯罪，是中國(guó)內(nèi)地的有組織犯罪的最高組織形式”向成熟的、典型的黑社會(huì)犯罪形態(tài)演變。 第三章，我國(guó)黑社會(huì)性質(zhì)組織犯罪的防治對(duì)策。從三個(gè)方面進(jìn)行論述：一是從加強(qiáng)刑事實(shí)體法的立法和健全程序法有關(guān)規(guī)定兩個(gè)方面，，論述黑社會(huì)性質(zhì)組織犯罪的法律對(duì)策；二是從建立并完善我國(guó)的專門針對(duì)黑社會(huì)性質(zhì)組織犯罪的偵查部門這一角度，論述黑社會(huì)性質(zhì)組織犯罪的組織對(duì)策；三是從大力發(fā)展經(jīng)濟(jì)、加大政治體制改革力度、堅(jiān)持綜合治理的方針以及宣傳發(fā)動(dòng)群眾等四個(gè)方面，論述了黑社會(huì)性質(zhì)組織犯罪的社會(huì)對(duì)策。
[Abstract]:Organized crime is not only a criminal problem, but also a social problem. In recent years, the crime of organized crime of underworld nature has become more and more widespread in our country, which has seriously damaged the social order and the order of production and life in our country, and has also attracted the attention of the theoretical circle of criminal law and the judicial practice department of our country. However, due to various reasons, there has been confusion in judicial practice about the identification of underworld organizations, and there is no unified understanding of criminal law theory. As a kind of organized crime, the underworld crime not only has the unique behavior characteristic, but also has the big difference with the other general gang crime, the underworld crime and so on. In view of how to identify the organized crime of underworld nature, this paper tries to analyze the formation reason and development trend of the organized crime of underworld nature in our country from the concept and characteristics of the organized crime of underworld nature. The author also makes a rough analysis of its preventive countermeasures, and thinks that it is a rational choice to establish a comprehensive control system with the character of rule of law, particularity and comprehensiveness to prevent the crime of organized crime of underworld nature. This article is divided into three chapters from the structure, a total of more than 30,000 words. The first chapter, the underworld nature organization crime summary. There are two different concepts of gangland organization and underworld organization crime. This chapter starts with the concept and characteristics of underworld organizations, and introduces the differences between underworld organizations and related criminal organizations, such as "criminal and evil forces", criminal syndicates, underworld organizations, terrorist organizations, and so on. From criminal organization to criminal behavior, the concept of organized crime with underworld nature is defined. The second chapter, our country underworld nature organization crime formation reason and the development trend. This paper analyzes the historical root, economic factor, social factor, political factor, external factor and so on, and points out the formation reason of the organized crime of the underworld character in our country. At the same time, combined with the current changing crime situation, this paper forecasts the development trend of the organized crime of underworld nature in our country: in the future period, our country starts from the present "organized crime of the underworld nature", It is the highest organizational form of organized crime in mainland China. The third chapter, the prevention and cure countermeasure of our country underworld nature organization crime. It is discussed from three aspects: first, from two aspects of strengthening the legislation of the criminal substantive law and perfecting the relevant provisions of the procedural law, discuss the legal countermeasures of the organized crime with the nature of the underworld; Second, from the angle of establishing and perfecting the investigation department of our country specifically aimed at the organized crime of the nature of the underworld, the paper discusses the organizational countermeasures of the crime of the organized crime with the nature of the underworld; third, from vigorously developing the economy and intensifying the reform of the political system, Adhering to the policy of comprehensive management and publicizing and arousing the masses, this paper discusses the social countermeasures of the organized crime of underworld character.
