【摘要】：隨著社會(huì)經(jīng)濟(jì)的發(fā)展，，人民生活水平也不斷提高，越來越多車輛走進(jìn)了普通家庭的生活中，機(jī)動(dòng)車輛的增加，隨之而來的交通環(huán)境發(fā)生了巨大的變化，交通安全管理的問題與傳統(tǒng)的執(zhí)法方式之間的矛盾也越來越明顯。這種情況就算現(xiàn)在發(fā)達(dá)如美國(guó)、英國(guó)、法國(guó)和德國(guó)等國(guó)在二十世紀(jì)七十年代也同樣出現(xiàn)過。這些國(guó)家不謀而合的地提出了采取智能交通的對(duì)策來解決當(dāng)時(shí)嚴(yán)峻的交通形勢(shì)，并先后研發(fā)出智能的交通系統(tǒng)以應(yīng)對(duì)交通安全管理中嚴(yán)峻的形勢(shì)。從這些國(guó)家?guī)资陙淼膶?shí)踐看來，電子交通警察系統(tǒng)在交通安全管理方面確實(shí)發(fā)揮了不可或缺的作用，電子交通警察系統(tǒng)已成為智能交通系統(tǒng)的重要的組成部分。鑒于此，我國(guó)可仿照這些國(guó)外的方法，引進(jìn)新型的電子交通警察執(zhí)法方式，以緩解我國(guó)現(xiàn)階段嚴(yán)峻的交通執(zhí)法壓力。就目前看，雖然電子交通警察執(zhí)法已經(jīng)顯現(xiàn)出其不可忽視的重大作用，但是在我國(guó)電子交通警察執(zhí)法還屬于一個(gè)新鮮事物，實(shí)踐經(jīng)驗(yàn)還很欠缺，在執(zhí)法的過程中難免存在這樣那樣的問題。當(dāng)然，這也是所有新生事物在發(fā)展過程中的必經(jīng)階段。 本文核心問題就是對(duì)電子交通警察執(zhí)法方面的相關(guān)問題進(jìn)行分析，并對(duì)這些相關(guān)問題提出意見和建議。主要分為三個(gè)部分： 第一部分是電子交通警察執(zhí)法概述。首先，對(duì)電子交通警察及其相關(guān)的概念進(jìn)行了闡釋，對(duì)其執(zhí)法方式進(jìn)行了界定，并分別與非現(xiàn)場(chǎng)執(zhí)法和暗中執(zhí)法進(jìn)行了比較分析；其次，介紹了電子交通警察執(zhí)法的發(fā)展歷史及法律依據(jù)；最后分析了電子交通警察執(zhí)法的積極作用。 第二部分分析電子交通警察執(zhí)法在實(shí)踐過程中存在的問題。主要從法律依據(jù)欠缺、執(zhí)法技術(shù)缺陷、執(zhí)法人員素質(zhì)不高、執(zhí)法程序不規(guī)范等方面存在的問題及原因進(jìn)行了剖析； 第三部分提出了完善電子交通警察執(zhí)法的對(duì)策。主要從健全相關(guān)法律法規(guī)、完善執(zhí)法程序、提高執(zhí)法隊(duì)伍素質(zhì)、加強(qiáng)執(zhí)法監(jiān)督等方面提出了筆者的看法。
[Abstract]:With the development of social economy, people's living standard has been improved, more and more vehicles have entered into the life of ordinary families, the number of motor vehicles has increased, and the traffic environment has changed greatly. The contradiction between traffic safety management and traditional law enforcement is becoming more and more obvious. This happened even now in countries such as the United States, Britain, France and Germany in the 1970s. These countries have put forward the countermeasure of adopting intelligent transportation to solve the severe traffic situation, and have developed intelligent transportation system to deal with the severe situation in traffic safety management. From the practice of these countries in recent decades, the electronic traffic police system has indeed played an indispensable role in traffic safety management, and the electronic traffic police system has become an important part of its. In view of this, our country can imitate these foreign methods, introduce the new electronic traffic police law enforcement method, in order to alleviate our country at present severe traffic law enforcement pressure. At present, although the law enforcement of electronic traffic police has shown its important role that can not be ignored, it is still a new thing in our country, and its practical experience is still very lacking. In the course of law enforcement, there are inevitably problems of one kind or another. Of course, this is all new things in the development process of the necessary stage. The core problem of this paper is to analyze the related problems in the law enforcement of electronic traffic police, and to put forward some opinions and suggestions. It is divided into three parts: The first part is an overview of electronic traffic police law enforcement. First of all, it explains the concept of E-traffic police and its related concepts, defines its law enforcement methods, and compares them with off-site law enforcement and covert law enforcement. This paper introduces the development history and legal basis of electronic traffic police law enforcement, and finally analyzes the positive role of electronic traffic police law enforcement. The second part analyzes the problems existing in the practice of e-traffic police law enforcement. Mainly from the lack of legal basis, law enforcement technical defects, the quality of law enforcement personnel is not high, law enforcement procedures are not standardized and other aspects of the problems and reasons are analyzed; The third part puts forward the countermeasure of perfecting the law enforcement of electronic traffic police. The author puts forward the author's views from the aspects of perfecting the relevant laws and regulations, perfecting the law enforcement procedure, improving the quality of the law enforcement team, strengthening the law enforcement supervision and so on.
