【摘要】： 群體性事件作為一種普遍的社會(huì)現(xiàn)象,由于政治、經(jīng)濟(jì)、法律、社會(huì)等各種因素?fù)诫s其中,客觀地存在于世界上任何一個(gè)國(guó)家,也是各國(guó)政府都普遍感到頭疼和棘手的一個(gè)問(wèn)題。 本文通過(guò)對(duì)目前社會(huì)上存在的多類群體性事件的分析,借鑒沖突理論和公共治理理論,對(duì)當(dāng)前我國(guó)群體性事件現(xiàn)在的特點(diǎn)和誘發(fā)原因進(jìn)行了深入地分析,認(rèn)為我國(guó)群體性事件現(xiàn)在的基本特征是起因的多樣性、主體的多元性、傳播的放大性、組織的策劃性、矛盾的復(fù)雜性、表現(xiàn)的激烈性,發(fā)生群體性事件主要實(shí)質(zhì)原因是階層和群體利益的重新調(diào)整分配和權(quán)力制約機(jī)制不足導(dǎo)致的腐敗現(xiàn)象、官僚主義、形式主義工作作風(fēng);并通過(guò)對(duì)當(dāng)前地方政府應(yīng)對(duì)群體性事件機(jī)制分析,認(rèn)為當(dāng)前地方政府應(yīng)對(duì)群體性事件機(jī)制主要障礙是防范機(jī)制落實(shí)難、化解機(jī)制暢通難、協(xié)調(diào)機(jī)制統(tǒng)一難、方式方法失當(dāng)、評(píng)價(jià)機(jī)制失衡。在此基礎(chǔ)上提出了地方政府應(yīng)對(duì)群體性事件保障機(jī)制建設(shè)對(duì)策,主要是:一、加強(qiáng)應(yīng)對(duì)群體性事件法律制度保障的環(huán)境建設(shè)。二、完善應(yīng)對(duì)群體性事件的工作機(jī)制建設(shè)主要有糾紛排查機(jī)制、矛盾調(diào)處機(jī)制、現(xiàn)場(chǎng)處置機(jī)制、善后機(jī)制。三、健全社會(huì)安全閥機(jī)制。四、加強(qiáng)社會(huì)自我調(diào)節(jié)機(jī)制。五、加強(qiáng)政府管理機(jī)制。
[Abstract]:As a general social phenomenon, group events exist objectively in any country in the world because of political, economic, legal, social and other factors. It is also a problem that governments all over the world feel headache and thorny. Based on the analysis of various kinds of group events in the present society and the theory of conflict and public governance, this paper makes a deep analysis of the current characteristics and causes of mass events in China. It is believed that the basic characteristics of mass events in China are the diversity of the causes, the pluralism of the subject, the amplification of the communication, the planning of the organization, the complexity of the contradiction and the intensity of the performance. The main causes of mass incidents are corruption, bureaucracy and formalism, which are caused by the readjustment and distribution of stratum and group interests and insufficient power restriction mechanism. Based on the analysis of the mechanism of local governments' response to mass incidents, the author thinks that the main obstacles of local governments' coping mechanism of mass incidents are the difficulty of implementing the preventive mechanism, the difficulty of resolving the unimpeded mechanism, the difficulty of unifying the coordination mechanism, and the improper ways and means. The evaluation mechanism is out of balance. On the basis of this, the author puts forward some countermeasures for the local government to build the guarantee mechanism for the collective incidents, mainly as follows: first, strengthen the environmental construction of the legal system to deal with the group incidents. Second, perfecting the working mechanism construction of dealing with group incidents mainly includes dispute investigation mechanism, contradiction mediation mechanism, spot disposal mechanism and aftercare mechanism. Third, perfect the mechanism of social safety valve. Fourth, strengthen social self-regulation mechanism. Fifth, strengthen the government management mechanism.
