【摘要】： 世界刑罰制度的創(chuàng)新需要用最有效、最人道、最文明的方式處理犯罪和犯罪人，社區(qū)矯正就是契合這一發(fā)展而產(chǎn)生的刑罰方式。為適應(yīng)國際形勢，2003年，我國下發(fā)了《關(guān)于開展社區(qū)矯正試點(diǎn)工作的通知》，改革和完善我國原有的社區(qū)矯正制度。從現(xiàn)行刑罰制度來看，我國的社區(qū)矯正有自己的體系和特色，但與國外相比，社區(qū)矯正的整體制度需要改革和重新構(gòu)建。為此，筆者想通過對國外社區(qū)矯正理念、種類、制度等的借鑒；通過對我國目前試點(diǎn)地區(qū)社區(qū)矯正刑罰執(zhí)行情況的分析與評價(jià)，，并且參考當(dāng)?shù)氐囊恍┳龇ǎ接懮鐓^(qū)矯正制度在理念、立法、執(zhí)行措施、管理體制方面的完善，以期對我國今后社區(qū)矯正的實(shí)際開展有所推動。
[Abstract]:The innovation of the world penalty system needs to deal with the crime and the criminal in the most effective, humane and civilized way. In order to adapt to the international situation, in 2003, our country issued the notice on the pilot work of Community Correction, which reformed and improved the original community correction system in China. From the point of view of the current penalty system, the community correction in our country has its own system and characteristics, but compared with foreign countries, the whole system of community correction needs to be reformed and rebuilt. Therefore, the author wants to draw lessons from the ideas, types and systems of community correction in foreign countries, and through the analysis and evaluation of the implementation of community correction penalties in the pilot areas of China at present, and refer to some local practices. This paper probes into the perfection of community correction system in the aspects of concept, legislation, executive measures and management system, in order to promote the actual development of community correction in China in the future.
