【摘要】：職務(wù)犯罪研究是我國(guó)刑事法學(xué)研究中的重要課題之一。本論文運(yùn)用了哲學(xué)、刑法學(xué)、犯罪學(xué)、社會(huì)學(xué)、心理學(xué)、政治學(xué)等學(xué)科的研究方法和學(xué)術(shù)觀點(diǎn)力求對(duì)職務(wù)犯罪的主要問(wèn)題進(jìn)行再認(rèn)識(shí)，尤其是結(jié)合高等教育領(lǐng)域職務(wù)犯罪的特殊性，并使其與職務(wù)犯罪的一般性相結(jié)合，思辯地與實(shí)證地對(duì)職務(wù)犯罪的認(rèn)識(shí)問(wèn)題和防控問(wèn)題進(jìn)行了研究。這些研究對(duì)職務(wù)犯罪的再認(rèn)識(shí)和職務(wù)犯罪預(yù)防的法制化具有重要的理論意義和現(xiàn)實(shí)意義。全文共分為以下四個(gè)部分： 第一部分，文章就職務(wù)犯罪的刑法學(xué)上和犯罪學(xué)上的概念進(jìn)行了界定和評(píng)析，重點(diǎn)對(duì)近些年國(guó)內(nèi)學(xué)界幾種職務(wù)犯罪概念進(jìn)行了綜述，并提出了本文關(guān)于職務(wù)犯罪刑法學(xué)上的概念，這也是犯罪學(xué)上職務(wù)犯罪概念的基礎(chǔ)。 第二部分，文章結(jié)合具體的事實(shí)和較為詳實(shí)的材料，總結(jié)了我國(guó)當(dāng)前職務(wù)犯罪的主要特點(diǎn)，并分析指出我國(guó)職務(wù)犯罪的發(fā)展趨勢(shì)。 第三部分，文章根據(jù)“犯罪綜合動(dòng)因論”對(duì)職務(wù)犯罪的原因進(jìn)行了系統(tǒng)論述。具體從四個(gè)方面揭示職務(wù)犯罪原因的復(fù)雜性。首先，，人性的局限性與權(quán)力的二重性是職務(wù)犯罪的深層原因；其次，體制轉(zhuǎn)軌與社會(huì)失范、監(jiān)督乏力與法網(wǎng)疏漏是滋生職務(wù)犯罪的客觀原因；再次，人生觀、價(jià)值觀錯(cuò)位以及由此形成的腐敗的權(quán)力觀是導(dǎo)致職務(wù)犯罪的主觀原因；最后，市場(chǎng)經(jīng)濟(jì)中消極因素的影響以及社會(huì)分配不公加上過(guò)熱的消費(fèi)心理的刺激引起行為人心理失衡是導(dǎo)致職務(wù)犯罪的潛在心理誘因。這些研究為職務(wù)犯罪的預(yù)防對(duì)策的確立提供了深刻而全面的理論依據(jù)和現(xiàn)實(shí)依據(jù)。 第四部分，文章探討了職務(wù)犯罪防控對(duì)策。首先，論者認(rèn)為防控職務(wù)犯罪必須確立全新的防控理念，其中，論者強(qiáng)調(diào)應(yīng)適應(yīng)當(dāng)前我國(guó)社會(huì)正在發(fā)生著計(jì)劃經(jīng)濟(jì)向市場(chǎng)經(jīng)濟(jì)轉(zhuǎn)變、一元化社會(huì)向多元化社會(huì)轉(zhuǎn)變的需要，用既合乎法律，又能保護(hù)社會(huì)經(jīng)濟(jì)繁榮發(fā)展、政治穩(wěn)定的方法手段來(lái)很好地預(yù)防職務(wù)犯罪。接著，據(jù)此理念，文章論述了從教育、管理監(jiān)督、法制等方面構(gòu)筑職務(wù)犯罪預(yù)防的全新機(jī)制，尤其是對(duì)建立和完善以檢察機(jī)關(guān)為中心的職務(wù)犯罪預(yù)防機(jī)構(gòu)進(jìn)行了探討，并提出了自己的建議。
[Abstract]:The research of duty crime is one of the important subjects in the criminal law research of our country. This thesis uses the research methods and academic viewpoints of philosophy, criminal law, criminology, sociology, psychology, political science and so on to re-understand the main problems of job-related crime. Especially combining the particularity of duty crime in the field of higher education and combining it with the general nature of duty crime, this paper studies the cognition and prevention and control of duty crime in a rational and empirical way. These studies have important theoretical and practical significance for the recognition of duty crime and the legalization of duty crime prevention. The full text is divided into the following four parts: In the first part, the author defines and comments on the concepts of duty crime in criminal law and criminology, focusing on the summary of several concepts of duty crime in domestic academic circles in recent years. This paper also puts forward the concept of duty crime in criminal law, which is also the basis of the concept of duty crime in criminology. In the second part, combining with the concrete facts and detailed materials, the paper summarizes the main characteristics of the present duty crime in our country, and points out the development trend of the duty crime in our country. In the third part, the author systematically discusses the reasons of duty crime according to the theory of comprehensive cause of crime. It reveals the complexity of the causes of duty crime from four aspects. First, the limitation of human nature and the duality of power are the deep causes of duty crime; secondly, the system transition and social anomie, the weakness of supervision and the omission of law net are the objective reasons to breed the duty crime; thirdly, the outlook on life, The dislocation of values and the resulting corruption of power are the subjective reasons leading to job-related crimes. The influence of negative factors in the market economy and the unfairness of social distribution and the stimulation of overheated consumption psychology lead to the psychological imbalance of the doer which is the potential psychological inducement of the crime of duty. These studies provide a profound and comprehensive theoretical and practical basis for the establishment of preventive measures against job-related crimes. The fourth part, the article has probed into the duty crime prevention and control countermeasure. First of all, the author thinks that it is necessary to establish a new concept of prevention and control in the prevention and control of job-related crimes. Among them, the commentators emphasize that we should adapt to the needs of the transformation from planned economy to market economy and from a unified society to a pluralistic society. To prevent duty crime by means of law, social and economic prosperity and political stability. Then, based on the concept, the article discusses the construction of a new mechanism for the prevention of job-related crimes from the aspects of education, management and supervision, legal system and so on, especially discusses the establishment and improvement of the preventive institutions of job-related crimes with the procuratorial organs as the center. And put forward their own suggestions.
