【摘要】： 加羅法洛的自然犯罪思想是犯罪學(xué)理論中一個(gè)較富魅力的話題，然而目前國(guó)內(nèi)對(duì)其尚缺乏研究。為了對(duì)它能有一個(gè)較為深刻的認(rèn)識(shí)和較為客觀的評(píng)價(jià)，本文首先梳理了加氏自然犯罪概念的論證推理過(guò)程，然后提供了對(duì)理解其思想必不可少的理論背景知識(shí)，接著給出了一個(gè)加羅法洛自然犯罪概念的完整表述，指出加氏提出此概念的目的所在，隨即介紹了他的自然犯罪思想的重要組成部分——自然犯罪人理論。在以上研究的基礎(chǔ)上，結(jié)合當(dāng)代的社會(huì)學(xué)與心理學(xué)理論，較為深入地剖析了加羅法洛自然犯罪思想的內(nèi)在缺陷。又進(jìn)行了加羅法洛與迪爾凱姆犯罪觀的比較研究，，以更加深化對(duì)加羅法洛自然犯罪思想的認(rèn)識(shí)。最后得出了本文的結(jié)論：加羅法洛自然犯罪思想是在特定的研究范式下得出的對(duì)于犯罪的一個(gè)錯(cuò)誤的認(rèn)識(shí)，對(duì)于我們研究本體的自然犯罪來(lái)說(shuō)，它不可能提供什么有重大價(jià)值的東西。
[Abstract]:Garo Fallo's natural crime theory is an attractive topic in criminology theory, but it is still lack of research in our country. In order to have a deeper understanding and more objective evaluation, this paper firstly combs the argumentation and reasoning process of the concept of natural crime, and then provides the necessary theoretical background knowledge for understanding his ideas. Then, a complete description of the concept of natural crime is given, and the purpose of the concept is pointed out, and then an important component of his natural crime theory, the theory of natural offender, is introduced. On the basis of the above research, combined with the contemporary theories of sociology and psychology, this paper deeply analyzes the inherent defects of Garo Fallo's thought of natural crime. In order to deepen the understanding of Garoflo's natural crime thought, the comparative study of Garo Farrow and Dilkem's view of crime is also carried out. Finally, the conclusion of this paper is drawn: Garo Fallo's natural crime thought is a wrong understanding of crime under the specific research paradigm, for us to study the natural crime of ontology, It cannot provide anything of great value.
