【摘要】：本文運(yùn)用博弈分析方法，在論證了刑訊逼供可以進(jìn)行博弈分析的基礎(chǔ)上，以假設(shè)刑訊逼供參與人是理性參與人為前提，將刑訊逼供行為模型化，通過(guò)對(duì)模型化后的刑訊逼供雙方當(dāng)事人——嫌疑人和警察在相互作用相互影響的基礎(chǔ)上進(jìn)行的可能導(dǎo)致刑訊逼供發(fā)生的各種因素進(jìn)行分析，以嫌疑人是否有罪為基本劃分原則，對(duì)雙方行為進(jìn)行歸類，并在此基礎(chǔ)上對(duì)雙方當(dāng)事人的策略及行為加以分析，以達(dá)到博弈的均衡時(shí)雙方傾向于選擇符合法律規(guī)定并能夠提高訴訟效率的策略及行動(dòng)為根本目標(biāo)，對(duì)可能影響雙方當(dāng)事人行為的因素進(jìn)行了分析，最終得出了通過(guò)改變嫌疑人和警察在訴訟過(guò)程中的收益狀況即可以影響嫌疑人和警察的行為的結(jié)論，并在此結(jié)論基礎(chǔ)上，在我國(guó)刑事訴訟法律框架內(nèi)，聯(lián)系我國(guó)司法機(jī)關(guān)工作實(shí)際，對(duì)如何能夠通過(guò)改變嫌疑人和警察的收益狀況進(jìn)而減少刑訊逼供案件的發(fā)生進(jìn)行了初步的討論。 本文從博弈的角度對(duì)刑訊逼供現(xiàn)象進(jìn)行了分析和研究，既對(duì)刑訊逼供問(wèn)題的研究尋找了一個(gè)新的方法，也對(duì)在類似問(wèn)題上運(yùn)用博弈分析進(jìn)行了有益的嘗試。
[Abstract]:Based on the analysis of game theory, this paper models the behavior of extorting confessions by torture on the premise that the participants are rational participants. Based on the analysis of various factors that may lead to torture on the basis of the mutual influence between the suspects and the police, the basic division principle is whether the suspects are guilty or not. On the basis of classifying the behavior of both parties and analyzing the strategies and behaviors of both parties, the basic goal is to achieve the equilibrium of game between the two parties and to choose the strategies and actions that conform to the law and improve the efficiency of litigation. This paper analyzes the factors that may affect the behavior of both parties, and finally comes to the conclusion that the behavior of suspects and police can be affected by changing the profit situation of suspects and police in the process of litigation, and on the basis of this conclusion, Within the legal framework of criminal procedure in our country and in connection with the actual work of judicial organs in our country, this paper discusses how to reduce the occurrence of cases of extorting confessions by torture by changing the income of suspects and police. This paper analyzes and studies the phenomenon of extorting confessions by torture from the point of view of game theory, which not only seeks a new method to study the problem of extorting confessions by torture, but also makes a beneficial attempt to apply game analysis to similar problems.
