【摘要】： 勞動教養(yǎng)作為一項具有中國特色的法律制度,為維護社會治安、預(yù)防和減少犯罪做出了重要貢獻。但是,隨著我國依法治國方略的實施以及建設(shè)社會主義法治國家進程的加快,勞動教養(yǎng)制度存在的弊端日益突出,招致了社會有關(guān)人士和法學(xué)界部分學(xué)者的質(zhì)疑和抨擊,因此,很有必要對勞動教養(yǎng)制度的歷史作用、現(xiàn)實價值和未來出路進行探討。 本文對勞動教養(yǎng)制度創(chuàng)立以來50年的發(fā)展歷程進行了回顧,把勞動教養(yǎng)制度的發(fā)展歷程分為五個階段:創(chuàng)立階段、初期發(fā)展階段、基本癱瘓階段、重建階段和改革創(chuàng)新階段,對各個階段的發(fā)展概況和特點作了簡單的概括。并對勞動教養(yǎng)制度進行了反思,認為其立法現(xiàn)狀與國家法制建設(shè)狀況不相適應(yīng),與立法法、行政處罰法、國際人權(quán)公約相關(guān)規(guī)定沖突,實踐中也存在諸多的弊端和問題,主要體現(xiàn)在法律性質(zhì)不確定,審批程序缺乏必要監(jiān)督制約機制,適用范圍不明確,法律性質(zhì)與其實際的嚴厲程度不相適應(yīng),司法救濟不夠充分,執(zhí)行過程存在弊端等方面。 文章中通過對勞動教養(yǎng)制度與國外輕罪制度、保安處分制度、少年教養(yǎng)制度的對比分析,考察國外相關(guān)制度的變遷及實際狀況,對勞動教養(yǎng)制度進行具體分析,看其內(nèi)在的聯(lián)系和相似性,辯證合理借鑒其原理和規(guī)則,以此推動勞動教養(yǎng)制度的改革與完善。 文章還對目前法學(xué)界存在的關(guān)于勞動教養(yǎng)制度出路的幾種觀點進行了分析,并提出了自己的看法。認為勞動教養(yǎng)應(yīng)當定性為處于刑罰和行政處罰之間的一種獨立的教養(yǎng)制度,是強制性的教育矯治措施,與刑事處罰、行政處罰共同構(gòu)成我國限制或剝奪人身自由的法律處分體系。并在此基礎(chǔ)上就未來勞動教養(yǎng)制度的模式做出設(shè)計,其審批程序采用司法程序,適用對象法定化,期限減少為1-6個月,對執(zhí)行管理模式進行改革,同時應(yīng)考慮與勞動教養(yǎng)相關(guān)制度及措施的一體化問題。
[Abstract]:As a legal system with Chinese characteristics, reeducation through labor has made important contributions to the maintenance of public order and the prevention and reduction of crime.However, with the implementation of our country's strategy of governing the country according to law and the acceleration of the process of building a socialist country ruled by law, the drawbacks of the system of re-education through labour have become increasingly prominent, which has aroused the doubts and criticisms of relevant social personages and some scholars in the field of law.It is necessary to probe into the historical function, realistic value and future outlet of the reeducation through labor system.This paper reviews the development of the re-education through labor system in the past 50 years, and divides the development process into five stages: the founding stage, the initial development stage, the basic paralysis stage, the reconstruction stage and the reform and innovation stage.The general situation and characteristics of each stage are briefly summarized.The author also reflects on the system of reeducation through labor and thinks that the present situation of legislation is not suitable for the construction of national legal system and conflicts with the relevant provisions of legislative law, administrative punishment law and international human rights convention, and there are many disadvantages and problems in practice.It is mainly reflected in the uncertainty of the nature of the law, the lack of necessary supervision and restriction mechanism in the examination and approval procedure, the unclear scope of application, the incompatibility of the nature of the law with its actual severity, the insufficiency of judicial relief and the malpractice of the execution process, etc.Through the comparative analysis of the reeducation through labor system and the foreign minor crime system, the security measure system, the juvenile education system, inspects the foreign related system change and the actual situation, carries on the concrete analysis to the reeducation through labor system.Looking at its internal connection and similarity, we can use its principle and rules for reference dialectically and reasonably, so as to promote the reform and perfection of the system of re-education through labor.The article also analyzes several viewpoints on the way out of the system of reeducation through labor in the field of law at present, and puts forward its own views.The author holds that reeducation through labour should be characterized as an independent system of reeducation between punishment and administrative punishment, which is a compulsory educational corrective measure and a criminal punishment.Administrative punishment constitutes the legal punishment system of restricting or depriving personal liberty in our country.On the basis of this, the author designs the model of the future reeducation through labor system. The examination and approval procedure adopts judicial procedure, the applicable object is legalized, the time limit is reduced to 1-6 months, and the executive management mode is reformed.At the same time, consideration should be given to the integration of systems and measures related to reeducation through labour.
