【摘要】: 本文以我國預防職務犯罪與《聯(lián)合國反腐敗公約》的接軌為研究主線,以與《聯(lián)合國反腐敗公約》相關的預防職務犯罪法律問題為研究內(nèi)容,先闡述了職務犯罪與預防職務犯罪的內(nèi)涵,剖析了職務犯罪產(chǎn)生的深層原因,然后對我國預防職務犯罪進行了歷史考察,指出我國預防職務犯罪存在的缺陷:一是缺乏法律保障,二是預防越位,三是權力監(jiān)督缺乏系統(tǒng)性,四是資產(chǎn)追回機制未與國際接軌。文章繼而對《聯(lián)合國反腐敗公約》的內(nèi)容與立法精神做了深度分析,論及了我國的職務犯罪防治與《聯(lián)合國反腐敗公約》接軌的必要性,比較了國外預防職務犯罪的方法,在此基礎上就《聯(lián)合國反腐敗公約》與我國預防職務犯罪機制的完善提出了自己的觀點,一是要完善懲治職務犯罪的立法體系,由立法機關制定一個關于預防職務犯罪工作的決定,將預防職務犯罪的具體規(guī)范和措施立法,加強對部門、行業(yè)規(guī)章制度中職務犯罪預防內(nèi)容的修訂和創(chuàng)制;二是要完善職務犯罪的預防機制,包括三方面的內(nèi)容:1)是統(tǒng)一的預防職務犯罪機制,2)是社會化預防機制,其中包括各有關預防主體單位分工負責,協(xié)調配合,共同發(fā)揮作用的程序和方式,3)是被預防單位內(nèi)部的預防工作機制;三是要完善監(jiān)督機制,加強對領導機關、領導干部特別是各級領導班子主要負責人的監(jiān)督,加強對財政資金運行的監(jiān)督;四是要完善資產(chǎn)追回機制,在資產(chǎn)追回程序中設立代理制度,在刑事訴訟法中設立缺席審判程序制度,在與外國締結包含刑事司法協(xié)助內(nèi)容的條約時增加關于相互分享被追回的犯罪收益的條款,或在必要時與有關外國針對具體案件達成分享犯罪收益協(xié)議。
[Abstract]:This paper focuses on the connection between the prevention of job-related crimes in China and the United Nations Convention against Corruption, and the legal issues related to the prevention of job-related crimes in the context of the United Nations Convention against Corruption.This paper expounds the connotation of duty crime and the prevention of duty crime, analyzes the deep causes of duty crime, and then makes a historical investigation on the prevention of duty crime in China.This paper points out the defects in the prevention of job-related crimes in China: first, lack of legal protection, second, prevention of offside, third, lack of systematization of power supervision, and fourth, lack of the mechanism of asset recovery in line with international standards.The article then makes an in-depth analysis of the content and legislative spirit of the UN Convention against Corruption, discusses the necessity of integrating the prevention and control of job-related crimes in China with the UN Convention against Corruption, and compares the methods of preventing job-related crimes abroad.On this basis, the author puts forward his own views on the perfection of the UN Convention against Corruption and the mechanism of preventing job-related crimes in China. First, it is necessary to perfect the legislative system for punishing job-related crimes.The legislature shall make a decision on the prevention of job-related crimes, legislate on the specific norms and measures for the prevention of job-related crimes, and strengthen the revision and creation of the contents of the prevention of job-related crimes in the rules and regulations of departments and industries;Second, it is necessary to improve the prevention mechanism of job-related crimes, including three aspects: 1) is a unified mechanism for the prevention of job-related crimes. 2) it is a socialized prevention mechanism, which includes the division of responsibilities and coordination among the units concerned in the field of prevention.The procedures and ways to play a joint role are the preventive work mechanism within the units under prevention; third, it is necessary to improve the supervisory mechanism and strengthen the supervision of leading organs and leading cadres, especially the principal responsible persons of the leading bodies at all levels.We must strengthen supervision over the operation of financial funds. Fourth, we should improve the asset recovery mechanism, set up a proxy system in the asset recovery procedure, and establish a system of trial proceedings in absentia in the criminal procedure law.Add provisions on the sharing of recovered proceeds of crime with foreign States when entering into treaties containing elements of criminal mutual legal assistance, or, where necessary, enter into agreements with the relevant foreign States on the sharing of proceeds of crime in specific cases.
