【摘要】：當(dāng)前行賄犯罪呈現(xiàn)犯罪主體文化程度較高,行賄作案的平均次數(shù)較多且居于高位運(yùn)行,涉案金額普遍較大,行賄犯罪發(fā)現(xiàn)難度大且主要依靠他案揭發(fā),犯罪對(duì)象、發(fā)案部位和環(huán)節(jié)相對(duì)集中,對(duì)行賄犯罪處罰較輕、緩刑適用率較高等特點(diǎn)。建議加大打擊行賄犯罪力度,大幅度增加行賄犯罪的查處概率和犯罪成本;改革行政審批制度,削減政府官員的任意處置權(quán),縮小尋租空間;以流程化和電子化來(lái)強(qiáng)化制度執(zhí)行,不斷減少并最終取消自由裁量權(quán)的尋租空間;以政務(wù)信息公開(kāi)為核心,加快制定有關(guān)制度的配套實(shí)施細(xì)則;規(guī)范執(zhí)法人員與中介代理機(jī)構(gòu)之間的交往行為。
[Abstract]:The current bribery crime presents a relatively high level of education of the criminal subject, the average number of bribery crimes is more and higher, the amount involved in the case is generally large, the bribery crime is difficult to find and mainly depends on the disclosure of other cases, the object of the crime.The location and links of the crime are relatively concentrated, the punishment for bribery crime is relatively light, and the probation rate is higher.It is suggested that we should step up efforts to crack down on bribery crimes, increase the probability and cost of investigating and punishing bribery crimes by a large margin, reform the administrative examination and approval system, reduce the arbitrary disposal power of government officials, and reduce the scope for rent-seeking.To strengthen the implementation of the system by flow and electronization, to reduce and eventually cancel the rent-seeking space of discretion, to speed up the formulation of relevant system implementation rules, to open government information as the core;Standardize the communication between law enforcement personnel and intermediary agencies.
