【摘要】：社區(qū)矯正是當(dāng)今世界各國(guó)刑罰執(zhí)行理論和實(shí)踐中發(fā)展最快的領(lǐng)域，也是以非監(jiān)禁刑逐步取代監(jiān)禁刑占主導(dǎo)地位的國(guó)際行刑趨勢(shì)的主要標(biāo)志之一。它代表了刑罰由嚴(yán)厲走向?qū)捑彽内厔?shì)，是刑罰發(fā)展的歷史潮流。 面對(duì)這一歷史潮流，中國(guó)的司法工作者也在努力研究。在上海、北京等地已經(jīng)開(kāi)始了社區(qū)矯正的試點(diǎn)。不管結(jié)果如何，畢竟我們已經(jīng)走出了第一步。這已經(jīng)是成功的開(kāi)始。社區(qū)矯正制度實(shí)際反映了對(duì)人權(quán)的真正關(guān)懷，對(duì)人的關(guān)愛(ài)。這也是這個(gè)制度價(jià)值之所在。 本文共分三章。第一章：中國(guó)社區(qū)矯正的實(shí)證考察。主要從“中國(guó)社區(qū)矯正的制度規(guī)范”和“中國(guó)社區(qū)矯正的改革與探索”兩個(gè)方面作了考察，前者所說(shuō)的“制度規(guī)范”分為直接規(guī)范(兩高、兩部的《通知》等)和間接規(guī)范(散見(jiàn)于刑法、刑訴法等中)。后者所說(shuō)的“改革與探索”重點(diǎn)考察了目前社區(qū)矯正做得相對(duì)成熟的上海、北京兩市，同時(shí)考察了中國(guó)社區(qū)矯正的執(zhí)行情況，在此基礎(chǔ)上甄別出目前我國(guó)社區(qū)矯正的特點(diǎn)及實(shí)踐中存在的問(wèn)題。從而提出了本文要重點(diǎn)解決的論題。 第二章：中國(guó)社區(qū)矯正的理論自足。理論是實(shí)踐的先導(dǎo)，沒(méi)有理論指導(dǎo)的實(shí)踐是盲目的實(shí)踐。本章從界定社區(qū)矯正及其相關(guān)概念著手，，借鑒西方國(guó)家社區(qū)矯正的理論(或理念)精華，并用以指導(dǎo)我國(guó)社區(qū)矯正的改革和實(shí)踐�！胺缸飳W(xué)上的標(biāo)簽理論”、“深化的復(fù)歸理論”、“刑罰人道主義理念”、“構(gòu)建和諧社會(huì)需要社區(qū)矯正”、“刑罰經(jīng)濟(jì)原則”等都或多或少、或明或暗為下文解決“審前社區(qū)矯正模式的創(chuàng)設(shè)”、“積極探索科學(xué)的社區(qū)矯正措施”、“建立和完善社區(qū)矯正的管理體制”等提供了依據(jù)。 第三章：中國(guó)社區(qū)矯正的改進(jìn)思路。本章從三個(gè)方面提出了我國(guó)社區(qū)矯正的改進(jìn)思路：一是審前社區(qū)矯正模式的創(chuàng)設(shè)，它主要以標(biāo)簽理論為依據(jù)，以西
[Abstract]:Community correction is the fastest growing field in the theory and practice of penalty enforcement in the world. It is also one of the main symbols of the international execution trend of replacing imprisonment penalty with non-imprisonment penalty, which represents the trend of penalty from severe to lenient, and is the historical trend of penalty development. In the face of this historical trend, Chinese judicial workers are also working hard to study. In Shanghai, Beijing and other places, community correction pilot projects have been started. No matter what the outcome, After all, we have taken the first step. This is the beginning of success. The community correction system actually reflects the real concern for human rights, care for people. This is the value of the system. This paper is divided into three chapters. Chapter one: the empirical investigation of Chinese Community Correction, mainly from the two aspects of "the Institutional norms of Chinese Community Correction" and "the Reform and Exploration of Chinese Community Correction". The former refers to the "institutional norms", which are divided into direct norms (two high levels, "notice of the two ministries", etc.) and indirect norms (scattered in the criminal law, etc.). The latter's "reform and exploration" focus on the two cities of Shanghai and Beijing, where community correction is relatively mature at present. At the same time, it examines the implementation of community correction in China. On this basis, the characteristics and problems existing in the practice of community correction in our country are identified, and the topics to be solved in this paper are put forward. Chapter two: the theoretical self-sufficiency of Chinese community correction. Theory is the forerunner of practice, and the practice without theory guidance is blind practice. This chapter begins with the definition of community correction and its related concepts. Learn from the essence of the western countries' community correction theories (or ideas), It is used to guide the reform and practice of community correction in our country. "the tagging theory in criminology", "the theory of return in depth", "the humanitarianism of penalty", "the construction of harmonious society needs community correction", "the principle of penalty economy" are all more or less. It provides the basis for the following solutions: the establishment of the pre-trial community correction model, the active exploration of scientific community correction measures, and the establishment and improvement of the management system of community correction. Chapter three: the improvement thought of Chinese community correction.
