【摘要】：在世界范圍內(nèi),公益勞動(dòng)制度作為一項(xiàng)重要的開(kāi)放性的矯治措施,已經(jīng)被大多數(shù)國(guó)家采用,制度體系也比較成熟。雖然各國(guó)關(guān)于公益勞動(dòng)制度的立法、定位與歸屬等有所不同,但是這并不妨礙其在各國(guó)實(shí)踐中的應(yīng)用,并取得了很好的司法效果與社會(huì)效益。而我國(guó)的公益勞動(dòng)制度作為社區(qū)矯正的一項(xiàng)矯正項(xiàng)目,起步較晚,歷時(shí)很短,經(jīng)驗(yàn)少,問(wèn)題多,尤其缺乏合法性與規(guī)范性。但是,這些都不能抹殺公益勞動(dòng)制度本身具有科學(xué)性、人道性與進(jìn)步性。 公益勞動(dòng)制度作為非監(jiān)禁性的刑罰執(zhí)行措施,代表了未來(lái)社會(huì)的行刑趨勢(shì),也是社會(huì)進(jìn)步的標(biāo)志。在我國(guó)的社區(qū)矯正中,公益勞動(dòng)制度集懲罰、教育與矯治于一身,具有重大的社會(huì)意義。社區(qū)服刑人員能通過(guò)勞動(dòng)來(lái)恢復(fù)他們的自尊心與自信心,也能補(bǔ)償因犯罪行為而給社會(huì)造成的損害與損失；同時(shí)也利于提高他們對(duì)社會(huì)的適應(yīng)能力,增強(qiáng)他們生產(chǎn)生活的技能與技巧,以幫助他們?cè)缛栈貧w社會(huì)。但是,我國(guó)的公益勞動(dòng)制度還處于起步階段,規(guī)范化還需要加強(qiáng),存在如立法缺失,工作原則模糊,制度不完善等諸多問(wèn)題。 本文的選題是我國(guó)社區(qū)矯正中的公益勞動(dòng)制度,其主要內(nèi)容是在考察國(guó)內(nèi)外公益勞動(dòng)制度的基礎(chǔ)上,結(jié)合我國(guó)的具體國(guó)情,完善我國(guó)社區(qū)矯正制度中公益勞動(dòng)的工作原則指導(dǎo)思想、組織管理與獎(jiǎng)懲制度,以期最好的發(fā)揮公益勞動(dòng)制度在社區(qū)矯正中應(yīng)有的懲罰、教育與矯治作用。
[Abstract]:In the world, the public welfare labor system as an important open corrective measures, has been adopted by most countries, the system is more mature, although countries on the public welfare labor system legislation. Positioning and attribution are different, but this does not hinder its application in the practice of various countries, and has achieved good judicial and social benefits. And our public welfare labor system as a correction project of community correction. The starting time is late, the time is short, the experience is very short, the question is many, especially lacks the legitimacy and the standard, but these can not wipe out the public welfare labor system itself to have the scientific nature, the humanity and the progress. The public welfare labor system, as a non-custodial penalty execution measure, represents the execution trend of the future society and is also the symbol of social progress. In the community correction of our country, the public welfare labor system sets punishment. Education and correction have great social significance. Community prisoners can restore their self-esteem and self-confidence through labor, and can also compensate for the damage and loss caused by criminal behavior. At the same time, it also helps to improve their ability to adapt to the society, enhance their skills and skills of production and life, so as to help them return to society as soon as possible. However, the public welfare labor system of our country is still in its infancy. Standardization needs to be strengthened, such as lack of legislation, vague working principles, imperfect system and so on. The topic of this paper is the public welfare labor system in the community correction of our country. Its main content is to combine the specific situation of our country on the basis of examining the public welfare labor system at home and abroad. In order to bring into play the role of punishment, education and correction in community correction system, we should perfect the guiding ideology of working principle, organization management, reward and punishment system of public service labor in community correction system in our country.
