【摘要】：改革開(kāi)放以來(lái)，我國(guó)經(jīng)濟(jì)建設(shè)不斷發(fā)展，市場(chǎng)經(jīng)濟(jì)的不斷深入，國(guó)家的工業(yè)化、現(xiàn)代化步伐也不斷加快，人們的生活水平也不斷提高，在我們?nèi)粘Ｉ钪�，出現(xiàn)了很多新產(chǎn)品，很多新能源不斷被人們廣泛應(yīng)用，因此各種安全隱患也有所上升。近年來(lái)，我國(guó)火災(zāi)、雪災(zāi)、地震、泥石流等自然災(zāi)害事故和社會(huì)群體安全事件等各種公共安全危機(jī)時(shí)有發(fā)生。故，為了更好的保護(hù)公共安全、進(jìn)行緊急救援、恢復(fù)和發(fā)展社會(huì)生產(chǎn)建設(shè)、促進(jìn)國(guó)民經(jīng)濟(jì)可持續(xù)發(fā)展，我們必須依靠一個(gè)強(qiáng)有力的應(yīng)急救援力量，這有賴于應(yīng)急救援中消防部隊(duì)作用的發(fā)揮。消防部隊(duì)承擔(dān)著消防保衛(wèi)和社會(huì)搶險(xiǎn)的雙重職能，是一支保護(hù)人民安全、維護(hù)經(jīng)濟(jì)建設(shè)的軍事化、專業(yè)化的隊(duì)伍，是我國(guó)的黨和人民忠誠(chéng)的衛(wèi)士，接受軍隊(duì)和政府的雙重領(lǐng)導(dǎo)，所以，我們認(rèn)為：在應(yīng)急救援中消防部隊(duì)不但屬于國(guó)家武裝力量，，同時(shí)也是我國(guó)是公安機(jī)關(guān)的重要職能部門。 但是，我國(guó)法律法規(guī)中并沒(méi)有明確規(guī)定消防部隊(duì)的法律地位，在應(yīng)急救援中，消防部隊(duì)作為國(guó)家武裝力量和國(guó)家公安機(jī)關(guān)的職能不甚分明，一定程度上沒(méi)有真正發(fā)揮應(yīng)急救援中消防部隊(duì)作為國(guó)家武裝力量和國(guó)家公安機(jī)關(guān)的真正作用和各方優(yōu)勢(shì)，應(yīng)急救援體系不統(tǒng)一、不協(xié)調(diào)。因此，我們有必要對(duì)消防部隊(duì)的雙重主體制度進(jìn)行法律研究，以期明確消防部隊(duì)的法律主體地位，建立協(xié)調(diào)統(tǒng)一、高效、專業(yè)技能強(qiáng)的救援隊(duì)伍。 本文通過(guò)對(duì)我國(guó)消防部隊(duì)在應(yīng)急救援中雙重主體地位的發(fā)展和形成展開(kāi)，分別論述在應(yīng)急救援中，消防部隊(duì)作為國(guó)家武裝力量的特征和作為國(guó)家公安機(jī)關(guān)的特征，從而分別闡述兩種主體身份在應(yīng)急救援中的權(quán)利義務(wù)以及法律責(zé)任，來(lái)印證其作為雙重主體地位的特征，并且發(fā)現(xiàn)在應(yīng)急救援中，兩種主體地位的統(tǒng)一性。同時(shí)，我們通過(guò)對(duì)美國(guó)的應(yīng)急救援主體的狀況和我國(guó)法律對(duì)在應(yīng)急救援中消防部隊(duì)主體地位等相關(guān)制度的現(xiàn)狀進(jìn)行了研究，發(fā)現(xiàn)美國(guó)應(yīng)急救援體系高度協(xié)調(diào)統(tǒng)一，政府重視消防，經(jīng)費(fèi)投入較大，消防設(shè)施比較完善，消防裝備先進(jìn)齊備，消防主體人員隊(duì)伍職業(yè)素質(zhì)較高等的可借鑒之處，以及我國(guó)應(yīng)急救援主體制度存在的問(wèn)題。最后，相互吸收、相互學(xué)習(xí)，提出了：立法明確消防部隊(duì)在應(yīng)急救援隊(duì)中的主體地位，建立統(tǒng)一聯(lián)動(dòng)救援主體體系，加強(qiáng)對(duì)消防部隊(duì)的保障，強(qiáng)化應(yīng)急救援訓(xùn)練和演練等解決措施，以期推動(dòng)我國(guó)的應(yīng)急救援法律制度建設(shè)，為實(shí)踐中應(yīng)急救援能力的提高提供可參考的建議。
[Abstract]:Since the reform and opening - up , our country ' s economic construction has been developing constantly , the market economy has been deepening , the modernization of the country has accelerated , people ' s living standards have also increased . In recent years , many new products have emerged , and many new energy sources have been widely used . Therefore , in order to better protect public safety , we must rely on a strong emergency rescue force , which is a military and professional team to protect the people ' s safety and maintain economic construction . Therefore , we believe that the fire - fighting forces are not only the national armed forces , but also the important functions of the public security organs in the emergency rescue . However , in our country ' s laws and regulations , the legal status of the fire - fighting forces is not clearly defined . In the emergency rescue , the fire - fighting forces are not very clear about the functions of the national armed forces and the public security organs , and the emergency rescue system is not unified and coordinated . Therefore , it is necessary for us to conduct legal research on the double subject system of the fire - fighting forces , with a view to clarifying the legal entity status of the fire - fighting forces , and establishing a rescue team with a unified , efficient and professional skills . Through the research on the development and formation of the double subject status of fire - fighting troops in the emergency rescue , the paper discusses the characteristics of fire - fighting forces as the national armed forces and the characteristics of the national public security organs , and finds out the unity of the two subjects ' status in emergency rescue . At the same time , we find out the main status of the emergency rescue system in the United States , the advanced equipment of fire - fighting equipment , the higher professional quality of the fire - fighting personnel , and the problems that exist in the main system of emergency rescue .
