人格尊嚴保護:網絡文明和網絡倫理建設的價值內核

【摘要】：網絡文明和網絡倫理建設是與網絡化、信息化共生的時代課題,其目的和意義在于保障和維護網絡空間信息生產、社會生活以及社會交往的優(yōu)良秩序和風清氣正的網絡環(huán)境。網絡文明和網絡倫理建設的首要問題是厘清其價值指向與價值訴求的問題。由于網絡空間中的一切活動都是現(xiàn)實的人在虛擬空間中的活動,所以人格尊嚴保護就邏輯地成為網絡文明和網絡倫理建設的價值內核和價值訴求。事實上,在實踐中,尤其在法律實踐中,保護人格尊嚴已經成為世界上許多國家的立法理念與法律活動的重要組成部分,并且有逐步向網絡空間虛擬化延伸的趨勢。因此,加強網絡空間人格尊嚴的法律保護,建設文明的具有倫理秩序的網絡社會,尊重和保護網絡空間中每一個公民的"虛擬人格尊嚴",對于構建和諧的網絡空間氛圍并推動中國特色社會主義的發(fā)展具有重要的理論和實踐意義。
[Abstract]:The construction of network civilization and network ethics is a subject of the times which is symbiosis with network and information. Its purpose and significance is to ensure and maintain the fine order of network space information production, social life and social communication, and the network environment of clearing the wind and clearing the air. The primary problem of network civilization and network ethics construction is to clarify its value direction and value demand. Since all activities in cyberspace are real activities of human beings in virtual space, the protection of human dignity has logically become the value core and value demand of the construction of network civilization and network ethics. In fact, in practice, especially in legal practice, the protection of human dignity has become an important part of the legislative concept and legal activities of many countries in the world, and there is a tendency to gradually extend to cyberspace virtualization. Therefore, we should strengthen the legal protection of the human dignity of cyberspace, build a civilized cyber society with ethical order, and respect and protect the "virtual human dignity" of every citizen in cyberspace. It has important theoretical and practical significance for constructing harmonious cyberspace atmosphere and promoting the development of socialism with Chinese characteristics.
