【摘要】：道德作為人們?cè)诂F(xiàn)實(shí)生活中應(yīng)該信奉的價(jià)值體系和行為規(guī)范,其功能的有效實(shí)現(xiàn)受制于道德本身的合理性。具體而言,這一合理性表現(xiàn)為與事理、情理和法理的契合。此三者,構(gòu)成了道德合理性的具體向度。在事理上,要提升把握道德真理的認(rèn)知能力,對(duì)道德建設(shè)進(jìn)行自覺反思,努力探究并昭示道德的內(nèi)在依據(jù);在情理上,要從“源頭”上確保道德與情理的契合,將人的快樂和幸福作為道德的最高價(jià)值追求而培養(yǎng)行為主體情感和能力;在法理上,要對(duì)法治建設(shè)進(jìn)行道德上的合義性論證,進(jìn)而確立法律信仰和法律權(quán)威,并運(yùn)用法治思維進(jìn)行道德建設(shè)和實(shí)踐。
[Abstract]:Morality, as the value system and behavior norm that people should believe in in real life, is restricted by the rationality of morality itself.Specifically, this rationality is reflected in the agreement with reason, reason and law.These three constitute the concrete direction of moral rationality.In principle, we should enhance the cognitive ability to grasp the moral truth, consciously reflect on the moral construction, and make great efforts to explore and reveal the internal basis of morality; in terms of reason, we should ensure the harmony between morality and reason from the "source".Taking happiness and happiness as the pursuit of the highest value of morality, we should cultivate the emotion and ability of the main body of behavior, in the legal theory, we should make moral argumentation on the construction of the rule of law, and then establish the legal belief and the authority of the law.And uses the rule of law thought to carry on the moral construction and the practice.
