【摘要】：容錯糾錯機制是政治領域新生的話語體系,并在實踐中為政治機構所悅納并積極推行,而在法治國家的語境下對其進行法學解析則有著特殊的意義。容錯糾錯機制的正當性可以從理性認知的價值局限、寬容理念的價值印證以及權力理性的實踐指向三個方面予以證成,容錯糾錯機制在實踐運行中彰顯出來的問題則需要法治化的戰(zhàn)略予以重構和規(guī)范。
[Abstract]:The fault-tolerant and error-correcting mechanism is a new discourse system in the political field, which is accepted and actively implemented by political institutions in practice, but it has special significance to analyze it in the context of a country ruled by law. The legitimacy of fault-tolerant and error-correcting mechanism can be proved from three aspects: the value limitation of rational cognition, the value confirmation of tolerance idea and the practice direction of power rationality. The problems of fault-tolerant and error-correcting mechanism in practice need to be reconstructed and standardized by the rule of law strategy.
