【摘要】：容錯(cuò)糾錯(cuò)機(jī)制是政治領(lǐng)域新生的話語體系,并在實(shí)踐中為政治機(jī)構(gòu)所悅納并積極推行,而在法治國家的語境下對(duì)其進(jìn)行法學(xué)解析則有著特殊的意義。容錯(cuò)糾錯(cuò)機(jī)制的正當(dāng)性可以從理性認(rèn)知的價(jià)值局限、寬容理念的價(jià)值印證以及權(quán)力理性的實(shí)踐指向三個(gè)方面予以證成,容錯(cuò)糾錯(cuò)機(jī)制在實(shí)踐運(yùn)行中彰顯出來的問題則需要法治化的戰(zhàn)略予以重構(gòu)和規(guī)范。
[Abstract]:The fault-tolerant and error-correcting mechanism is a new discourse system in the political field, which is accepted and actively implemented by political institutions in practice, but it has special significance to analyze it in the context of a country ruled by law. The legitimacy of fault-tolerant and error-correcting mechanism can be proved from three aspects: the value limitation of rational cognition, the value confirmation of tolerance idea and the practice direction of power rationality. The problems of fault-tolerant and error-correcting mechanism in practice need to be reconstructed and standardized by the rule of law strategy.
