網(wǎng)絡(luò)反腐:虛擬社會(huì)中公民監(jiān)督權(quán)的行使

【摘要】:黨的十八大以來,黨中央全面從嚴(yán)治黨、狠抓懲治腐敗。反腐敗已成為國內(nèi)外各界的共識,不斷打破“禁區(qū)”和“慣例”。改革開放以來從未有過的反腐力度,預(yù)示著中共反腐進(jìn)入“新常態(tài)”。當(dāng)前我國腐敗問題的嚴(yán)重性,損害了政治、經(jīng)濟(jì)的發(fā)展,人們對腐敗分子深痛惡覺;ヂ(lián)網(wǎng)技術(shù)的發(fā)展,給社會(huì)帶來巨大的變革,公民利用網(wǎng)絡(luò)可以行使自己的監(jiān)督權(quán),揭發(fā)不法行為,掀起了網(wǎng)絡(luò)反腐的熱潮。本文以網(wǎng)絡(luò)中公民行使監(jiān)督權(quán)為主切入點(diǎn),運(yùn)用文獻(xiàn)研究法、交叉學(xué)科法、比較研究方法,圍繞網(wǎng)絡(luò)反腐的內(nèi)容、時(shí)代背景、歷史進(jìn)程,網(wǎng)絡(luò)環(huán)境下公民監(jiān)督權(quán)行使的影響等方面進(jìn)行了分析。同時(shí)對網(wǎng)絡(luò)環(huán)境下如何規(guī)范公民監(jiān)督權(quán)的行使提出了一些的對策。網(wǎng)絡(luò)反腐,是相對于傳統(tǒng)制度反腐而言的,是以網(wǎng)絡(luò)為平臺通過民意聚集倒逼權(quán)力的他律方式。網(wǎng)絡(luò)反腐的主要方式是網(wǎng)民行使監(jiān)督權(quán)、參與權(quán)等基本權(quán)利,舉報(bào)和揭露貪污腐敗行為和貪腐分子,在一定程度上可以促進(jìn)政策科學(xué)化及政治民主化。但是,網(wǎng)絡(luò)的虛擬性使公民行使監(jiān)督權(quán)時(shí)面臨諸多問題,如:網(wǎng)絡(luò)反腐的事實(shí)依據(jù)是否具有客觀真實(shí)性、監(jiān)督主體的情緒化問題、監(jiān)督方式是否存在“暴力侵權(quán)”以及如何規(guī)范有效地行使公民網(wǎng)絡(luò)監(jiān)督權(quán)等。網(wǎng)絡(luò)反腐雖然彌補(bǔ)了傳統(tǒng)反腐方式的不足,但由于部分反腐主體的缺失,不能夠離開整個(gè)反腐體系而單獨(dú)發(fā)揮作用。網(wǎng)絡(luò)反腐要規(guī)范有序的發(fā)揮其積極作用,需要建立官民互動(dòng)的長效機(jī)制,做好政務(wù)信息公開工作,暢通網(wǎng)絡(luò)監(jiān)督渠道。還要建立以法律為根本、以社會(huì)多元主體共同治理為基礎(chǔ)、以事中和事后監(jiān)管為重點(diǎn)的互動(dòng)合作式治理模式。加快建設(shè)法律、制度、技術(shù)等多位一體的治理手段,堅(jiān)持系統(tǒng)治理、依法治理、綜合治理、源頭治理。
[Abstract]:Since the 18th National Congress of the Party, the Party Central Committee has strictly governed the Party and cracked down on corruption. Anti-corruption has become the consensus of all circles at home and abroad, breaking the forbidden zone and convention. Since the reform and opening-up has never been the strength of anti-corruption, the Communist Party of China to enter the "new normal anti-corruption." At present, the seriousness of corruption in our country has damaged the development of politics and economy. With the development of Internet technology, great changes have been brought to the society. Citizens can exercise their right of supervision, expose illegal behavior, and set off an upsurge of network anti-corruption. This paper focuses on the content, background and historical process of network anti-corruption by using literature research method, cross-disciplinary method and comparative research method, which mainly focus on the citizens' exercise of supervisory power in the network, and use the literature research method, cross-disciplinary method and comparative research method. Under the network environment, the influence of citizen's right of supervision is analyzed. At the same time, it puts forward some countermeasures on how to regulate the exercise of citizen's supervisory power under the network environment. Network anti-corruption, as opposed to the traditional system anti-corruption, is based on the network platform through the gathering of public opinion to force the power of the other way. The main way of network anti-corruption is to exercise the right of supervision and participation, to report and expose corruption and corrupt elements, to a certain extent, to promote the scientific policy and political democratization. However, the virtual nature of the network makes citizens face many problems when they exercise their supervisory power, such as: whether the factual basis of network anti-corruption has objective authenticity, the emotional problem of the supervisory subject, Whether there is "violence infringement" in the way of supervision and how to regulate and effectively exercise the right of civil network supervision. Although the network anti-corruption makes up for the shortcomings of the traditional anti-corruption methods, it can not play its role alone because of the lack of some anti-corruption subjects. In order to play its positive role in a standardized and orderly manner, the network anti-corruption should establish a long-term mechanism of interaction between the officials and the people, do a good job in the publicity of government information, and open the channels of network supervision. It is also necessary to establish an interactive and cooperative governance model based on the principle of law, on the basis of common governance of social pluralistic subjects, and on supervision after the event. Speed up the construction of laws, systems, technology and other multi-integrated governance means, adhere to system governance, according to law, comprehensive management, source management.
