【摘要】：司法是人權(quán)救濟(jì)的最后防線,人權(quán)司法保障的強(qiáng)化應(yīng)當(dāng)致力于實(shí)現(xiàn)四大轉(zhuǎn)變:從人權(quán)上升為訴權(quán),以保障知情權(quán)、陳述權(quán)、辯護(hù)辯論權(quán)、申請(qǐng)權(quán)、申訴權(quán);從人權(quán)法律原則細(xì)化為人權(quán)法律規(guī)則,以落實(shí)罪刑法定、疑罪從無(wú)和非法證據(jù)排除制度;從紙上的權(quán)利現(xiàn)實(shí)化為行動(dòng)中的權(quán)利,以強(qiáng)制執(zhí)行維護(hù)法律權(quán)威和保障勝訴權(quán)利;從信訪過(guò)份擴(kuò)張轉(zhuǎn)變到依法終結(jié)涉法涉訴信訪,以達(dá)致維權(quán)的法治化和專業(yè)化。
[Abstract]:Judicature is the last line of defense of human rights remedy, and the strengthening of human rights judicial guarantee should be devoted to realizing four major changes: from human rights to litigation rights, to protect the right to know, to be heard, to defend and debate, to apply for application and to appeal; From the principle of human rights law to the rule of human rights law, in order to carry out the legality of a crime, to exclude the suspected crime from no evidence and illegal evidence, from the realization of the right on paper to the right in action, to enforce and safeguard the legal authority and the right to win a lawsuit; From the excessive expansion of petition to the end of litigation and petition in accordance with the law, to achieve the rule of law and specialization.
