【摘要】：一直以來,人類與腐敗進(jìn)行著不斷的斗爭(zhēng),加強(qiáng)對(duì)權(quán)力的監(jiān)督和制約,構(gòu)建和完善相應(yīng)的廉政文化是全人類共同的不懈追求。黨的十八大以來,黨中央高度重視、全面推進(jìn)黨風(fēng)建設(shè),廉政文化建設(shè)現(xiàn)今已成為一個(gè)熱門話題,廉政文化建設(shè)的形式也呈現(xiàn)多樣化趨勢(shì)。在這個(gè)過程中,與法治精神的結(jié)合是推進(jìn)廉政文化建設(shè)進(jìn)一步發(fā)展的必然要求。實(shí)踐證明,沒有法治精神相關(guān)理念的支撐,廉政文化建設(shè)只是空中樓閣。目前,我國(guó)的廉政文化建設(shè)仍主要依靠道德建設(shè),一方面缺少制度的硬性規(guī)定,另一方面廉政建設(shè)主體缺乏法治意識(shí)。厘清法治精神與廉政文化建設(shè)的內(nèi)在關(guān)系,把法治精神作為構(gòu)建廉政文化的重要內(nèi)容,對(duì)我國(guó)廉潔政府的建設(shè),依法治國(guó)方略的貫徹,必將起到有力的推動(dòng)作用。因此,研究我國(guó)法治精神與廉政文化建設(shè)的現(xiàn)狀以及國(guó)外相關(guān)的成功經(jīng)驗(yàn),探索正確處理法治精神與廉政文化建設(shè)的關(guān)系,對(duì)于推進(jìn)我國(guó)廉政文化建設(shè)以及建設(shè)廉潔政府具有積極意義。本文除引言和結(jié)語(yǔ)外,分為四大部分：第一部分從法治精神和廉政文化建設(shè)的理論入手,闡述了各相關(guān)概念的內(nèi)涵,論述了法治精神的基本理念與廉政文化建設(shè)要求的一致性,說明廉政文化建設(shè)離不開法治精神的支撐。第二部分分析了我國(guó)廉政文化建設(shè)中存在的問題,并分析了相關(guān)問題產(chǎn)生的原因。第三部分通過考查分析境外處理法治精神與廉政文化建設(shè)關(guān)系的成功范例,借鑒其相關(guān)經(jīng)驗(yàn)。第四部分在借鑒境外經(jīng)驗(yàn)的基礎(chǔ)上結(jié)合我國(guó)具體實(shí)際,就我國(guó)正確處理廉政文化與法治精神關(guān)系提出了具體三點(diǎn)建議：完善廉政立法加快廉政文化建設(shè)、健全廉政機(jī)構(gòu)保障廉政文化建設(shè)、加強(qiáng)廉政監(jiān)督促進(jìn)廉政文化建設(shè)。
[Abstract]:Human beings have been constantly fighting against corruption. It is the common and unremitting pursuit of all mankind to strengthen the supervision and restriction of power and to construct and perfect the corresponding culture of clean government. Since the 18 Congress of the CPC. The CPC Central Committee attaches great importance to promoting the construction of the Party style in an all-round way, and the construction of a clean government culture has become a hot topic, and the forms of the construction of a clean government culture are also showing a diversified trend. The combination with the spirit of the rule of law is an inevitable requirement for the further development of the cultural construction of a clean government. Practice has proved that without the support of the related concepts of the spirit of the rule of law, the construction of a clean government culture is just a castle in the air. The construction of clean government culture in our country still mainly relies on moral construction. On the one hand, it lacks the rigid regulation of the system, on the other hand, the subject of clean government construction lacks the consciousness of rule of law. Taking the spirit of rule of law as an important part of the construction of clean and honest government and the implementation of the strategy of governing the country according to law will certainly play a powerful role in promoting it. This paper studies the present situation of the spirit of ruling by law and the construction of clean government culture in China and the successful experience of foreign countries, and explores the relationship between the spirit of rule of law and the construction of clean government culture. In addition to the introduction and conclusion, this paper is divided into four parts: the first part starts with the spirit of rule of law and the theory of clean government construction. This paper expounds the connotation of various related concepts and discusses the consistency between the basic concept of the spirit of rule of law and the requirements of building a clean government culture. It shows that the construction of clean government culture can not be separated from the support of the spirit of the rule of law. The second part analyzes the problems existing in the construction of clean government culture in China. The third part analyzes the successful examples of the relationship between the spirit of rule of law and the construction of clean government culture. Learn from its relevant experience. 4th part of the foreign experience on the basis of the combination of China's specific reality. This paper puts forward three specific suggestions on how to correctly deal with the relationship between the culture of clean government and the spirit of rule by law: perfecting the legislation of clean administration and speeding up the construction of culture of clean government, and perfecting the organization of clean administration to guarantee the construction of. Strengthening the supervision of a clean government and promoting the building of a clean government culture.
