【摘要】：網(wǎng)絡(luò)自助出版作為新興出版形式,顛覆了傳統(tǒng)出版業(yè)中作者與出版社的地位與關(guān)系。出版社不再處于核心地位,作者本身充當(dāng)著出版者的角色。而網(wǎng)絡(luò)自助出版平臺(tái)本質(zhì)上為網(wǎng)絡(luò)服務(wù)提供商,兩者在自助出版過(guò)程中的地位與權(quán)利需要明確。傳統(tǒng)的版式設(shè)計(jì)權(quán)歸屬、專有出版權(quán)的適用也產(chǎn)生了困境。然而該出版形式的出現(xiàn)并沒(méi)有影響著作權(quán)理論基礎(chǔ),完善著作權(quán)立法、正確適用法律為問(wèn)題解決之道。
[Abstract]:The self-service of the network, as a new form of publishing, subverts the status and relationship of the author and the publishing house in the traditional publishing industry. The publisher is no longer in the core, and the author herself acts as a publisher. The network self-service publishing platform is essentially a network service provider, and the status and rights of both the self-service publishing platform and the network service provider need to be clear. The application of the traditional layout design right belongs to the special publishing right, and the application of the exclusive publishing right also has the difficulty. However, the appearance of the publishing form does not affect the foundation of the copyright theory, perfect the copyright legislation, and correct the applicable law as the solution to the problem.
