【摘要】：技術(shù)進(jìn)步是版權(quán)擴(kuò)張的直接原因,但是版權(quán)擴(kuò)張的程度已經(jīng)超過應(yīng)對技術(shù)挑戰(zhàn)的需要,引發(fā)一系列的負(fù)面影響。這場由歐美發(fā)達(dá)國家主導(dǎo)的版權(quán)擴(kuò)張運(yùn)動已經(jīng)遭到學(xué)界和司法界的批判,版權(quán)的過度擴(kuò)張會扼殺文化和技術(shù)創(chuàng)新、知識的自由傳播,威脅公眾自由接觸和使用知識的權(quán)利,中國以及印度等發(fā)展中國家的版權(quán)學(xué)者則擔(dān)心發(fā)達(dá)國家版權(quán)過度擴(kuò)張會引發(fā)新一輪的“文化殖民主義”。本文探討了數(shù)字環(huán)境下版權(quán)擴(kuò)張所引發(fā)的一系列問題,并針對我國版權(quán)擴(kuò)張的實(shí)際提出具體的應(yīng)對措施。 文章分四個(gè)部分,緒論說明了選題的背景、意義和目的；第一部分從版權(quán)擴(kuò)張的主要表現(xiàn)入手,從版權(quán)的客體、版權(quán)的內(nèi)容以及技術(shù)保護(hù)措施三方面介紹版權(quán)在全球擴(kuò)張的情況；第二部分提出版權(quán)擴(kuò)張所引發(fā)的主要問題,闡述了版權(quán)擴(kuò)張對創(chuàng)作自由、技術(shù)發(fā)展、合理使用和權(quán)力窮竭原則的負(fù)面影響,指出版權(quán)擴(kuò)張已經(jīng)超過合理的限度,打破了傳統(tǒng)版權(quán)制度努力在激勵(lì)創(chuàng)作和鼓勵(lì)知識傳播之間維持的平衡,盡管其擴(kuò)張的初衷是使傳統(tǒng)版權(quán)法適應(yīng)數(shù)字化環(huán)境,但是過度擴(kuò)張實(shí)質(zhì)上加深了版權(quán)制度的“數(shù)字危機(jī)”；第三部分分析版權(quán)擴(kuò)張的正當(dāng)性,首先介紹了國外理論界對知識產(chǎn)權(quán)正當(dāng)性的分析,知識產(chǎn)權(quán)功利論是當(dāng)今西方知識產(chǎn)權(quán)理論界證成知識產(chǎn)權(quán)正當(dāng)性使用最廣泛的理論,該理論使用經(jīng)濟(jì)分析方法分析制度的合理性,將抽象模糊的正當(dāng)性標(biāo)準(zhǔn)以直觀、量化的方式展現(xiàn)具有較強(qiáng)的說理性,通過分析得出盡管版權(quán)在全球范圍內(nèi)的擴(kuò)張已經(jīng)打破版權(quán)人同公共利益之間的平衡,其次提出由于各個(gè)國家法律實(shí)施的狀況、技術(shù)發(fā)展的程度不同,版權(quán)擴(kuò)張帶來的實(shí)際影響并不相同,分析版權(quán)擴(kuò)張的正當(dāng)性必須同具體國家的實(shí)際相結(jié)合,僅從目前版權(quán)擴(kuò)張的全球化趨勢斷定其正當(dāng)與否沒有現(xiàn)實(shí)意義；第四部分提出我國應(yīng)當(dāng)完善版權(quán)限制制度以應(yīng)對版權(quán)的擴(kuò)張,首先從我國版權(quán)擴(kuò)張的現(xiàn)狀出發(fā),分析我國版權(quán)立法中存在的問題,其次通過與國際上應(yīng)對版權(quán)擴(kuò)張的經(jīng)驗(yàn)相比較,提出我國完善版權(quán)限制制度的具體措施,指出我國應(yīng)當(dāng)遏制版權(quán)肆意擴(kuò)張的勢頭,為創(chuàng)作提供必要激勵(lì)的同時(shí),促進(jìn)知識的傳播和共享,最大程度釋放出文化創(chuàng)造和技術(shù)進(jìn)步的活力。
[Abstract]:Technological progress is the direct cause of copyright expansion, but the extent of copyright expansion has exceeded the need to meet the technological challenges, causing a series of negative effects. The copyright expansion movement, led by developed countries in Europe and the United States, has been criticized by academic and judicial circles. Excessive copyright expansion will stifle cultural and technological innovation, free dissemination of knowledge, and threaten the public's right of free access to and use of knowledge. Copyright scholars in developing countries such as China and India worry that overexpansion in developed countries could trigger a new wave of "cultural colonialism." This paper discusses a series of problems caused by copyright expansion in digital environment, and puts forward some concrete measures to deal with the actual situation of copyright expansion in China. The article is divided into four parts, the introduction explains the background, significance and purpose of the topic; The first part introduces the global expansion of copyright from three aspects: the object of copyright, the content of copyright and the technical protection measures. The second part puts forward the main problems caused by copyright expansion, expounds the negative effects of copyright expansion on the principles of freedom of creation, technological development, rational use and exhaustion of power, and points out that the expansion of copyright has exceeded the reasonable limit. Breaking the balance that the traditional copyright system tries to maintain between encouraging creation and encouraging the spread of knowledge, even though its expansion is intended to adapt traditional copyright law to the digital environment, But the excessive expansion actually deepens the "digital crisis" of the copyright system; The third part analyzes the legitimacy of copyright expansion, first introduces the analysis of the legitimacy of intellectual property rights in foreign theorists, intellectual property utilitarianism is the most widely used theory of intellectual property rights in the western intellectual property theory. The theory uses the economic analysis method to analyze the rationality of the system, and presents the abstract and fuzzy legitimacy standard in an intuitive and quantitative way with a strong sense of rationality. Through analysis, it is concluded that although the global expansion of copyright has broken the balance between copyright owners and the public interest, the second point is that the degree of technological development is different because of the state of law enforcement in various countries. The actual influence brought by copyright expansion is not the same. The analysis of the legitimacy of copyright expansion must be combined with the actual situation of a specific country, and it is of no practical significance to judge whether it is legitimate or not only from the current globalization trend of copyright expansion; The fourth part puts forward that our country should perfect the copyright restriction system to deal with the expansion of copyright. Firstly, from the current situation of copyright expansion in China, the problems existing in the copyright legislation of our country are analyzed. Secondly, by comparing with the international experience in dealing with copyright expansion, this paper puts forward some concrete measures to perfect the copyright restriction system in China, and points out that China should contain the momentum of copyright wanton expansion and provide the necessary incentives for creation at the same time. Promote the dissemination and sharing of knowledge to maximize the vitality of cultural creation and technological progress.
