【摘要】：著作權(quán)質(zhì)權(quán)是指以著作財(cái)產(chǎn)權(quán)為標(biāo)的物而設(shè)定的質(zhì)權(quán)。2010年4月《中華人民共和國(guó)著作權(quán)法》進(jìn)行了第二次修改,這次修改在第一次修改的基礎(chǔ)上增加了一條,即第26條,將著作權(quán)質(zhì)押?jiǎn)栴}首次寫進(jìn)了著作權(quán)法當(dāng)中。著作權(quán)質(zhì)押在我國(guó)現(xiàn)階段實(shí)踐中成功案例較少,但存在巨大的上升空間,有必要進(jìn)行研究以使之服務(wù)于我國(guó)的經(jīng)濟(jì)建設(shè)。 著作權(quán)質(zhì)押合同是著作權(quán)質(zhì)權(quán)成立的前提條件,我國(guó)目前對(duì)著作權(quán)質(zhì)權(quán)的設(shè)立以著作權(quán)質(zhì)押合同登記為生效要件,這與西方國(guó)家以登記為對(duì)抗要件有所不同,體現(xiàn)出我國(guó)行政干預(yù)的特點(diǎn)。難點(diǎn)部分是著作權(quán)的價(jià)值評(píng)估,由于著作權(quán)質(zhì)押屬于權(quán)利質(zhì)押,作品類型、同類作品數(shù)量、作者聲望、作品的法律和經(jīng)濟(jì)壽命均對(duì)價(jià)值有重要影響,使得著作權(quán)的價(jià)值只能處于一種相對(duì)穩(wěn)定狀態(tài),增加了著作權(quán)質(zhì)押融資的難度。為了完善著作權(quán)質(zhì)押,應(yīng)建立健全的著作權(quán)質(zhì)押配套法律與價(jià)值評(píng)估制度,并建立著作權(quán)質(zhì)押的補(bǔ)償金制度,從而保障著作權(quán)質(zhì)押制度的有效運(yùn)行。
[Abstract]:Copyright pledge refers to the pledge right that is created on the subject of the property right of works. In April 2010, the copyright Law of the people's Republic of China made a second amendment, this time adding an article on the basis of the first amendment, that is, Article 26. The issue of copyright pledge was first written into copyright law. There are few successful cases in the practice of copyright pledge in our country at present, but there is a huge room for rise, so it is necessary to study it in order to serve the economic construction of our country. The copyright pledge contract is the prerequisite for the establishment of copyright pledge. At present, the registration of copyright pledge contract is the effective condition in our country, which is different from that in western countries. It reflects the characteristics of administrative intervention in our country. The difficult part is the value evaluation of copyright. Because the pledge of copyright belongs to the pledge of rights, the type of work, the number of similar works, the reputation of the author, the legal and economic life of the work all have important influence on the value. The value of copyright can only be in a relatively stable state, which makes the financing of copyright pledge more difficult. In order to perfect the copyright pledge, we should establish a sound law and value evaluation system of copyright pledge, and establish the compensation system of copyright pledge, so as to ensure the effective operation of copyright pledge system.
