【摘要】：數(shù)字版權(quán)管理是維護(hù)版權(quán)權(quán)利人或持有人在數(shù)字版權(quán)經(jīng)濟(jì)關(guān)系中法律權(quán)利的終極保護(hù)方式。因此,數(shù)字版權(quán)管理前期設(shè)計(jì)邏輯主要是先授權(quán)使用后監(jiān)視管理方式,由于效果差強(qiáng)人意,而后數(shù)字版權(quán)管理開(kāi)始大量使用連續(xù)性不間斷監(jiān)視與管理方式,從而排除非法授權(quán)訪問(wèn)與獲取資源。進(jìn)而,數(shù)字版權(quán)管理同時(shí)并列出現(xiàn)兩種不同技術(shù)方案,延伸為兩種截然不同的數(shù)字版權(quán)管理模式。分析數(shù)字版權(quán)管理面臨的困境,提出劃分出兩種不同管理模式將成為分析數(shù)字版權(quán)管理法律問(wèn)題至關(guān)重要的因素。在此基礎(chǔ)上,根據(jù)相應(yīng)特點(diǎn)將其稱為"柔性數(shù)字版權(quán)管理"與"剛性數(shù)字版權(quán)管理",而后分析兩種模式在數(shù)字版權(quán)管理過(guò)程中的機(jī)制與產(chǎn)生的問(wèn)題。清晰地分析出兩種數(shù)字版權(quán)管理模式,將對(duì)我國(guó)數(shù)字版權(quán)管理中相關(guān)法律問(wèn)題具有重要實(shí)踐意義。
[Abstract]:Digital rights management is the ultimate way to protect the legal rights of copyright owners or holders in the economic relationship of digital rights. Therefore, the design logic of digital rights management in the early stage is mainly authorization to use after monitoring management mode, because the effect is not satisfactory, then digital rights management began to use a large number of continuous monitoring and management mode. In order to exclude illegal authorization access and access to resources. Furthermore, there are two different technology schemes in digital rights management, which are extended to two different digital rights management models. This paper analyzes the dilemma faced by digital rights management, and points out that dividing two different management modes will be the most important factor in analyzing the legal problems of digital rights management. On this basis, it is called "flexible digital rights management" and "rigid digital rights management" according to the corresponding characteristics. Then, the mechanism and problems of the two models in the process of digital rights management are analyzed. It is of great practical significance to analyze two kinds of digital rights management models clearly, which will be of great practical significance to the related legal problems of digital rights management in China.
